Title:Politično pravo na Slovenskem : diplomsko delo

Abstract:V diplomskem delu je začrtano samostojno polje pravne znanosti - politično pravo, ki je bilo na Slovenskem zaradi teh ali onih razlogov neustrezno spregledano oziroma delno pripisano polju, ki se mu ponavadi pravi ustavno pravo, redkeje državno pravo, pa tudi polju človekovih pravic (še posebej političnih). Avtor se prek osnovnih definicij spoprime s samim pojmom, zaokroženostjo političnega prava v širšem in ožjem pomenu, predvsem pa pripravi seznam zakonodaje in posredno tudi literature, ki pride v poštev pri vzpostavitvi samostojnega predmeta, bodisi kot pedagoškega ali zgolj akademskega, nenazadnje pa prek konkretnih primerov pojasni, kako taka vzpostavitev za sabo povleče tudi določene praktične posledice. V zgodovinskem delu avtor odpre in dokaže glavne pomanjkljivosti v dosedanjem tradicionalnem pojmovanju in predstavljanju slovenske zgodovine, hkrati pa prav pravne vsebine izpostavi kot eno ključnih orodij za pričakovano prevrednotenje le-te. Verjetno najpomembnejši in najbolj praktičen del naloge pomeni pregled "gordijskih vozlov", za katerih izčiščevanje si je avtor vzel slabega četrt stoletja, da je v praksi preveril ter posredno potrdil njihovo strateško pomembnost. Ustavno sodišče je izpostavljeno kot torišče številnih politično-pravnih vprašanj, prav njegova vloga pa se izkaže kot ključna pri analizi ravni demokratičnosti in legitimnosti političnega sistema v Sloveniji.

Abstract:The thesis presents and outlines an independent field of legal science - political law - that has been for some reasons unsuitably overlooked in Slovenian culture and partially attributed to the field of constitutional law, rarely state law, as well as to the field of human rights (especially political ones). To begin with, the term 'political law' is tackled through basic definitions and then discussed as a whole, both in broad and narrow meaning, but foremost, a list of legislation is prepared together with all the literature that could come in question when establishing an independent subject, may it be as a pedagogic or merely an academic one, and last-but-not-least, through some practical examples, is explained how such restoration brings along certain practical consequences. In the historical part the author opens and establishes major shortcomings in traditional comprehension and presentation of Slovene history up to this point, while at the same time he exposes the very legal issues as one of the key elements in the expected re-evaluation of it. Probably the most important and most practical part of the thesis thus is the overview of the "Gordian knots" of which the elaboration took a quarter of century for the author to verify and to indirectly confirm their strategic importance. The Constitutional Court is identified as the crux of many political-legal questions and its role is displayed as key role in analysing the level of democracy and legitimacy of the political system in Slovenia.
