Title:Priporni razlog ponovitvene nevarnosti v povezavi s pravico do osebne svobode in domnevo nedolžnosti : diplomsko delo

Abstract:Predmetno diplomsko delo obravnava institut pripornega razloga ponovitvene nevarnosti v povezavi z ustavno varovano pravico do osebne svobode in z domnevo nedolžnosti. Metode, ki so bile uporabljene za izdelavo tega dela, so predvsem induktivno-deduktivna metoda, analitična metoda ter deskriptivna in komparativna metoda. Velik del priprave vsebine tega dela je temeljil na preučevanju domače in tuje literature, še posebej sodnih odločb slovenskih sodnih organov ter ESČP in 5. člena EKČP. Primarni namen diplomskega dela je bilo preučiti priporni razlog ponovitvene nevarnosti, saj je odreditev pripora, če ta ne temelji na dovolj visoki stopnji dokazljivosti, da je osumljena oseba res storila očitano ji kaznivo dejanje, lahko velik poseg v osebno svobodo in kršitev domneve nedolžnosti. Dejstvo je, da je določeno stopnjo dokazljivosti ponovitvene nevarnosti, torej sklepanja o prihodnjem negotovem dejstvu, v praksi težko utemeljiti. Cilj diplomskega dela je bil ugotoviti, ali je priporni razlog ponovitvene nevarnosti upravičljivi razlog za odreditev pripora ter kdaj oziroma v kakšnih primerih in okoliščinah. Ugotovitve so pokazale, da gre pri odreditvi pripora na temelju razloga ponovitvene nevarnosti nedvomno za poseg v pravico do osebne svobode in domnevo nedolžnosti, saj je priporniku odvzeta prostost, še predno je njegova (morebitna) krivda ugotovljena s pravnomočno sodbo, zgolj na temelju očitka storitve prihodnjih kaznivih dejanj, pri čemer še niti pretekla niso bila dokazana. Kljub temu je smisel in namen tega pripornega razloga širši od pravice posameznika do osebne svobode in se kaže v zagotavljanju varnosti ljudi ter pozitivne dolžnosti države, npr. v zvezi z varstvom pravice do življenja.

Abstract:This paper studies the grounds for detention due to the risk of reoffending in relation to the constitutional right to personal freedom and the presumption of innocence. It was written by applying the inductive and deductive method, the analytical method as well as the descriptive and comparative method. A vast amount of content preparation for the paper was based on the review of Slovene and foreign literature, especially court decisions of Slovene judicial authorities, the ECtHR and Article 5 of ECHR. The primary aim of the paper was to examine the grounds for detention due to the risk of reoffending. If it is not based on a high enough level of demonstrability, the imposition of detention can be a serious interference with personal freedom and a violation of the presumption of innocence. In practice, it is in fact difficult to justify a certain level of demonstrability of the risk of reoffending, in other words, the presumption of a future uncertain fact. The aim of the paper was to determine whether the grounds for detention due to the risk of reoffending are a justifiable reason for the imposition of detention, and to find out the circumstances in which this can be done. The findings showed that, when it comes the imposition of detention based on the risk of reoffending, an interference with the right to personal freedom and the presumption of innocence can be observed. The detainee is thus deprived of liberty % their (possible) guilt not is determined with a final judgement, but it is solely based on allegations that they might commit criminal offences in the future, while their past offences have not yet been proved. The purpose of the grounds for detention goes beyond the sole right of an individual to personal freedom and it is manifested in ensuring people's security and positive duties of a country, for example, those related to the protection of the right to life.
