Title:Mediacija kot oblika alternativnega reševanja sporov : diplomsko delo

Abstract:Spori so pogosto zapleteni v pravnem smislu, vedno pa so posledica porušenih odnosov med ljudmi. V mediaciji lahko tako stranke rešijo konkretni pravni spor, hkrati pa tudi izboljšajo medsebojne odnose in zmanjšajo možnosti zaostrovanja sporov v prihodnje. V procesu mediacije igra pomembno vlogo nevtralna oseba, mediator, ki pomaga strankam, da dosežejo sporazum. Proces mediacije je neformalen, prostovoljen in zaupen. Zaradi vseh teh prednosti se v zadnjem času vse več strank odloča, da bodo spor reševale s pomočjo tega postopka. Rešitev mediacije pa je lahko tudi brez pravnih elementov, kar pomeni, da se lahko zaključi z obžalovanjem, moralno zavezo ali opravičilom. Za mediacijo so primerni vsi spori, kar pomeni, da se postopki mediacije izvajajo v vseh sporih iz gospodarskih, delovnih, civilnopravnih, družinskih in drugih premoženjskopravnih razmerij ter v drugih sporih, kadar to ustreza naravi razmerja. Ravno zaradi fleksibilnega postopka, mediacija ni omejena na formalnost, kot to velja za sodni postopek. Stranki glede na svoje interese tudi po končani mediaciji dogovor zapišeta v primerni obliki. Zaradi tega, so rešitve dolgotrajneše in trdnejše. Znano je namreč tudi, da se ljudje bolj držijo dogovorov, ki so se jim zavezali sami, kot pa s strani sodišča določenim obveznostim. Skozi diplomsko delo so izpostavljene najbolj pomembne lastnosti mediacije, osredotočila sem se izključno na preučevanje mediacije, kot oblike alternativnega reševanja sporov. Namen diplomskega dela je tako večja informiranost javnosti o tej obliki alternativnega reševanja sporov.

Abstract:Disputes are often legally very complicated, but they are always a consequence of disturbance in the relationships between humans. Trough mediation the participants can solve their legal dispute and improve their mutual relationship and therefore eliminate the possibility of any future disputes. In the process of mediation there is an important role of a neutral person, the mediator, who helps the participants to achieve the agreement. The process of mediation itself is informal, voluntary, and confidential. Because of these advantages more clients decide to solve their dispute trough the process of mediation. Resolution that participants achieve in mediation can be without any legal elements, meaning that the mediation can also be resolved with remorse, moral bond, or apology that the participants must comply with and are bound by. The mediation is suitable for all types of disputes. It can be used as means of solving economic, labour, civil law, family, property law and any other type of dispute when it suits the nature of the relationship. Mediation process is, because of its' flexibility, not limited by the formalities that apply to judicial proceedings. After the mediation participants write down the agreement that they achieved in the process of it, which contributes to a permanent and firmer solution of the relationship between participants. It is known that humans are more likely to comply with the agreements which they bound to themselves than the obligations that are determined by the court. Trough the thesis are emphasized the most important properties of mediation. Primary focus is on exploring mediation as an alternative way of dispute resolution. The intent of a thesis is vaster knowledge of the public about this form of alternative dispute resolution.
