Title:Pravna ureditev prestopov nogometnih igralcev : diplomsko delo

Abstract:Prestopi nogometnih igralcev se dogajajo med prestopnima rokoma, in sicer dvakrat na leto. Pravila, ki urejajo statuse igralcev, načine prestopov in druge povezane dejavnosti s prestopi, na mednarodni ravni določa FIFA, znotraj posameznih držav pa v skladu z njihovimi pravili še nacionalne nogometne zveze. V diplomskem delu so najprej na kratko predstavljeni zgodovina nastanka prestopov ter dve najpomembnejši odločitvi Sodišča EU, poleg tega so splošno predstavljene tudi bistvene značilnosti mednarodnih prestopov nogometnih igralcev. Bolj podrobno pa je prikazano, kako je s prestopi nogometnih igralcev v Republiki Sloveniji in kako je z drugimi instituti, ki pridejo v poštev pri prestopih nogometnih igralcev, kot so npr. posoja igralca, sklenitev pogodbe o profesionalnem igranju nogometa, zastopanje igralca ipd. Opisana so še pravila, ki imajo posreden vpliv na prestope igralcev, predvsem pravila UEFE glede financ in vzgoje mladih nogometašev. V zadnjem poglavju naloge je opisano, katere institucije in na podlagi česa so pristojne za reševanje sporov, ki lahko nastanejo med potekom prestopa. Končni cilj diplomskega dela je narediti opisno kompilacijo bistvenih pravnih pravil iz pravnih aktov, ki urejajo področje prestopov nogometnih igralcev, prav tako pa tudi predstaviti, katere pravne predpostavke in obveznosti mora določen klub izpolniti, da lahko igralec, ki vanj prestopa iz drugega, začne igrati zanj.

Abstract:Football transfers occur during transfer windows twice per year. The regulations about the status and transfers of players and other activities connected to transfers on the international level are set by FIFA. In accordance with these rules, national associations set their own rules which are used when it comes to national transfers. This thesis begins with a brief historical presentation of football transfers. Furthermore, it introduces the two most important rulings of Court of Justice of the European Union in the field of football transfers. The main part of the thesis talks about a general legal presentation of the international football transfers and also about a detailed presentation of the registration of players in the Republic of Slovenia. Other important legal institutes of football transfers like loans, signing professional contracts, representation of players etc. are also described. Moreover, it includes the presentation of UEFA regulations, which have an indirect effect on football transfers. In the final chapter there is a description of judicial bodies competent for resolution of disputes that may occur during players% transfers. The aim of the thesis is to form a document with a compilation and description of the most important rules that are in force in the field of football transfers. In addition, it also includes the obligations that a certain football club has to perform, so that a player, who is transferred to that club, can legally start playing for them.
