Title:Ekološki vidik zasebne lastnine : magistrsko delo

Abstract:Družba se vse bolj zaveda pomena varovanja okolja, kar vodi do novih okoljskih zakonov in omejitev. Na drugi strani imamo zasebno lastnino, varovanje katere je prav tako izrednega pomena za razvito in demokratično družbo. Različne države imajo različno stopnjo varovanja pravice do zasebne lastnine ter različno stopnjo skrbi za okolje. Najvišje na lestvici so evropske države, najnižje pa države v razvoju oziroma države z bolj avtokratičnim političnim sistemom. Niti dajanje absolutne prednosti varovanju zasebne lastnine pred varovanjem okolja niti obratno v nobenem pogledu ni razumna rešitev in vodi do problemov v delovanju družbe. Magistrsko delo se osredotoča na korelacijo med pravico do zasebne lastnine in omejitve v smislu ekološke funkcije lastnine. Pri raziskovanju so bile uporabljene naslednje raziskovalne metode: opisna metoda, zgodovinska metoda, metoda analize in primerjalna metoda. Namen magistrskega dela je ugotoviti in predstaviti razmerje med okoljsko zakonodajo ter pravico do zasebne lastnine. Ključni cilji, ki jih magistrsko delo zasleduje, so: preučiti, kako je pravica do zasebne lastnine upoštevna ter zaščitena v Republiki Sloveniji in po svetu, prikazati korelacijo med varstvom zasebne lastnine in varstvom okolja ter preučiti najboljše razmerje med pravico do zasebne lastnine in varstvom okolja, kar se lahko uporabi pri načrtovanju okoljske zakonodaje, in sicer na način, ki poleg učinkovitega varstva okolja ne predstavlja škodljivih omejitev posameznikove pravice do zasebne lastnine. Omejitve raziskave so predvsem v dostopnosti pravnih virov tujih držav.

Abstract:Society is becoming increasingly aware of the importance of environmental protection, which leads to new environmental laws and restrictions. On the other hand, there is private property, the protection of which is also extremely important for a developed and democratic society. Different countries have different levels of protection of the right to private property and different levels of care for the environment. At the top of the scale are European countries and at the bottom are developing countries or countries with a more autocratic political system. Giving absolute priority to private property protection and neglecting environmental protection or vice versa is in no way a reasonable solution and leads to societal problems. This master%s thesis focuses on the correlation between the right to private property and restrictions in terms of the ecological function of property. The following research methods were used: descriptive method, historical method, method of analysis and comparative method. The purpose is to determine and present the relationship between environmental legislation and the right to private property. The key objectives are: to examine how the right to private property is relevant and protected, to show the correlation between private property protection and environmental protection and to examine the best relationship between the two, which can be used in future planning of environmental legislation in a way that it provides effective environmental protection but does not constitute harmful restrictions on an individual's right to private property. The limitations are mainly due to the accessibility of foreign countries% legal resources.
