Title:Prosti preudarek v upravnem postopku : diplomsko delo

Abstract:Prosti preudarek pomeni, da lahko uradna oseba na podlagi zakonskega pooblastila, pri istem dejanskem stanju, sprejme dve ali več odločitev, ki so si med seboj po vsebini različne, a so vse pravno pravilne. Razlika je le v ugodnem ali neugodnem izidu za stranko. Pojem prosti preudarek ima v slovenskem jeziku več sinonimov, kot so ''diskrecija'', ''diskrecijska pravica'', ''diskrecijsko pooblastilo''. Najpogosteje se odloča po prostem preudarku v konkretnih upravnih zadevah, torej v okviru upravnega postopka, katerega rezultat je posamičen upravni akt, s katerim se odloči o pravici, obveznosti ali pravni koristi stranke. Uradna oseba pri odločanju na podlagi diskrecijske pravice izmed več pravno dopustnih odločitev izbere tisto, ki je glede na okoliščine konkretnega primera in javno korist najbolj ustrezna, primerna oziroma smotrna. Odločba, izdana na podlagi diskrecijske pravice, mora biti izdana v mejah pooblastila in v skladu z namenom, za katerega je pooblastilo dano. Takšna odločba mora vsebovati navedbo predpisa, ki uradno osebo pooblašča za odločanje na podlagi diskrecijske pravice ter mora biti obrazložena predvsem v tistem delu, kjer je bila diskrecija uporabljena. Odločanje po prostem preudarku je pravno vezano. Pri njem je potrebno upoštevati tako načelo zakonitosti, ki preprečuje samovoljno odločanje, kot tudi načelo enakega varstva pravic in načelo sorazmernosti, ki uradno osebo zavezuje, da v podobnih primerih sprejema podobne odločitve, v različnih primerih pa sprejema tako različne odločitve, kot je to proporcionalno z razlikami, ki obstajajo v dejanskem stanju posameznih primerov.

Abstract:Administrative discretion denotes that an official, on the basis of authority determined by the law and by the same state of facts, can make two or more decisions which differ from each other in substance yet are all legally correct. The difference lies only in a favourable or unfavourable outcome for the party. The term administrative discretion has several synonyms in the Slovenian language, such as discretion, discretionary right and discretionary power. In most cases, arbitrariness is used with specific administrative matters, i.e. within the administrative procedure, of which the result is an individual administrative act, with which a decision is made about a right, obligation or legal benefit of a party. An official, while choosing among several legally permissible decisions on the basis of discretional right, chooses the one which is the most suitable, appropriate or reasonable in regards to the circumstances and public benefit. A decision, issued on the basis of a discretionary power, must be issued within the limits of its powers and in accordance with the purpose for which it has been issued. Such a decision must contain an indication of regulation, which authorises an official to act on the basis of discretionary right and must be explained especially in the part where discretion has been used. A discretionary decision is bound by law. The principle of legality, which prevents arbitrary decisions, the principle of equal protection of rights and the principle of proportionality must be observed. The latter principle legally binds an official to make similar decisions in similar cases and different decisions in proportion to the differences in the actual state of facts of individual cases.
