Title:Uvedba sistema prednostnega glasu kot ena izmed možnosti uresničitve odločbe Ustavnega sodišča Republike Slovenije U-I-32/15 : diplomsko delo

Abstract:Dve najpomembnejši vprašanji, s katerima se stroka in politika že dolgo časa ukvarjata, sta vprašanje skladnosti volilnega sistema, kot je določen v Zakonu o volitvah v DZ z Ustavo RS, in vprašanje njegove primernosti za naše politične razmere. Ta tematika je z odločbo Ustavnega sodišča U-I-32/15, ko je slednje na zahtevo Državnega sveta presojalo ustavno skladnost Zakona o volitvah v državni zbor in Zakona o določitvi volilnih enot za volitve poslancev v državni zbor, zopet postala aktualna. Ustavno sodišče v omenjeni odločbi zapiše, da volilni sistem v veljavni ureditvi ni neskladen z ustavo, pri čemer je izbira med načini glasovanja o kandidatih vprašanje primernosti zakonske ureditve, ki spada v polje proste presoje zakonodajalca. Odločba Ustavnega sodišča št. U-I-32/15 tako narekuje predvsem ustrezne spremembe in dopolnitve 4. člena Zakona o določitvi volilnih enot za volitve poslancev v državni zbor v zvezi z mejami volilnih okrajev. Diplomsko delo predstavlja veljavni volilni sistem in različne oblike prednostnega glasu, prav tako pa razčlenjuje različne vidike uvedbe t. i. preferenčnega glasu kot ureditve, ki bi hkrati %rešila% vprašanje meja volilnih okrajev, ki ga naslavlja odločba US RS U-I-32/15, saj bi se ti ohranili zgolj na administrativni ravni.

Abstract:The two most important issues that the legal profession and politics have been dealing with for a long time are the issue of compliance of the electoral system, as defined in the National Assembly Elections Act, with the Constitution of the Republic of Slovenia, and its suitability for our political situation. With the decision of the Constitutional Court U-I-32/15-65, which assessed the constitutionality of the National Assembly Elections Act and the Act Establishing Constituencies for the Election of Deputies to the National Assembly, this particular topic became topical again. In the aforementioned decision, the Constitutional Court writes that the electoral system in the current regulation is not inconsistent with the Constitution, whereby the choice between the methods of voting on candidates is a question of the adequacy of the statutory regulation, which falls within the legislator's discretion. The decision of the Constitutional Court No. U-I-32/15-56 thus dictates, above all, appropriate amendments to Article 4 of the Act Establishing Constituencies for the Election of Deputies to the National Assembly in relation to the boundaries of constituencies. The diploma thesis focuses on the presentation of the current electoral system and different forms of preferential voting, and analyzes various aspects of the preferential vote as an arrangement that would "solve" the issue of the boundaries of constituencies, which is addressed by the decision of the Constitutional Court of the Republic of Slovenia U-I-32/15-65.
