Title:Primerjava pravne podlage pri odcepitvi Slovenije s katalonskimi osamosvojitvenimi težnjami : magistrsko delo

Abstract:V tem delu obravnavamo primerjavo uspešne slovenske osamosvojitve z do tedaj neuspešno katalonsko odcepitvijo, osredotočamo pa se predvsem na možnosti, ki jih Kataloncem ponuja njihovo notranje državno pravo in mednarodno pravo, ter kako so reagirala sodišča v enem oziroma drugem primeru. Kronološko obdelamo tako slovensko osamosvojitveno pot, kot katalonska prizadevanja po neodvisnosti, na koncu pa za lažjo predstavo o položaju Katalonije opišemo še primera odcepitve Kosova in nacionalističnega gibanja na Škotskem. Uporabljamo primerjalno metodo, saj konstantno primerjamo en primer z drugim, zgodovinsko metodo, ko opišemo potek razvoja slovenskega in katalonskega naroda ter njuna položaja skozi zgodovino, analitična metoda pride v poštev predvsem pri analiziranju sodb oziroma odločb in pri analizi zakonodaj ene in druge skupne države oziroma ene in druge zakonodaje določene enote, pri opisovanju političnih sistemov znotraj posamezne skupne države pa je uporabljena deskriptivna metoda. Namen magistrskega dela je predvsem z vidika pravne podlage osvetliti, zakaj je bila slovenska osamosvojitev razmeroma hitra in uspešna ter zakaj imajo pri tem Katalonci toliko težav. Poleg tega bistvenega vprašanja in iskanja odgovora nanj, je namen dela tudi raziskati možnosti, ki jih Katalonija ima za dosego svojega cilja, in oceniti, ali je to trenutno realno.

Abstract:In this thesis, we discuss the comparison of a successful Slovenian secession with the thus far unsuccessful Catalan separation, focusing mainly on the possibilities offered to Catalans by their domestic state law and international law and how the national courts reacted in each case. We chronologically process both the Slovenian independence path and the Catalan efforts for independence, at the end, to simplify the idea of the position of Catalonia, we also describe examples of the secession of Kosovo and the nationalist movement in Scotland. Throughout the work we use the comparative method, as we constantly compare one situation with another, the historical method, when describing the development of the Slovenian and Catalan nations and their position throughout history, the analytical method comes into consideration mainly in analysing court decisions and both legislations of a particular unit, and a descriptive method is used to describe political systems within each multinational state. The purpose of the master's thesis is mainly from the point of view of the legal basis to shed light on why Slovenian independence was relatively smooth and successful and why Catalans now have little to no chance on achieving sovereignty. In addition to this essential question and the search for an answer to it, the purpose of the work is also to explore the possibilities that Catalonia has, to achieve its goal and to assess whether this is currently realistic.
