Title:Pravica do zdravega življenjskega okolja : magistrsko delo

Abstract:Magistrska naloga obravnava pravico do zdravega življenjskega okolja. Republika Slovenija zagotavlja pravico do zdravega življenjskega okolja v 72. členu Ustave. V prvem delu magistrskega dela smo podrobno predstavili zgodovinski razvoj pravice do zdravega življenjskega okolja. Proučili smo pravno ureditev na nacionalni, regionalni in mednarodni ravni. Podrobneje smo predstavili diplomacijo, njeno zgodovinsko razvojno pot in smernice, ki jih ubira danes. V drugem delu smo preučili okoljevarstvene zahteve v novo nastalih ustavah posameznih držav ter predstavili vrste sodnih odločitev in njihove posledice. V zadnjem delu raziskave pa smo odgovorili na postavljene hipoteze. Pri proučitvi teoretičnega gradiva, ki smo ga uporabili pri pisanju magistrskega dela, smo prišli do naslednjega zaključka: Stanje današnje družbe je odsev njenega vsakdana, vpetega v službo in preživetje in omejenega z iluzijo o ugodnem življenju. V tem omejenem mišljenju ni prostora za razumevanje zakonov narave, niti usmiljenja do soljudi, kaj šele do živali. V pohlepni praksi za več, za boljše smo si podjarmili okolje, živali, ljudi, vse, kar se je dalo, za dosego ciljev, katerih rezultati so vidni na deponijah in v onesnaženem okolju. Celotno početje človeškega roda je potrebo do temeljev pretresti in spremeniti. Glede na naše zakrivanje oči smo prepričani, da v kolikor ne bomo pravočasno spremenili našega obnašanja in naših vrednot, bo narava to naredila sama, brez nas. Izstavila bo račun za onesnaženje okolja, ki ga sejemo po zemlji, sad tega sajenja pa nam ne bo všeč, če bomo med izbranci, ki bodo preživeli.

Abstract:The master's thesis deals with the right to a healthy environment. The Republic of Slovenia guarantees the right to a healthy environment in Article 72 of the Constitution. In the first part of the master's thesis, we presented in detail the historical development of the right to a healthy environment. We examined the legal framework at the national, regional, and international levels. We have presented diplomacy in more detail, its historical development path, and the guidelines it is following today. In the second part, we examined the environmental protection requirements in the newly created constitutions of individual countries and presented the types of court decisions and their consequences. In the last part of the research, we answered the set hypotheses. In studying the theoretical material we came to the following conclusion: The state of today%s society is a reflection of its everyday life embedded in work and survival. There is no room for understanding the laws of nature. There isn't compassion for fellow human beings and animals. In the greedy practice for more, we have subjugated the environment, animals, people. The results of which are visible in landfills and polluted environment. We are witnessing chaotic changes in nature.
