Title:Družinski zakonik - razmejitev odločanja med centri za socialno delo in okrožnimi sodišči : diplomsko delo

Abstract:Uvedba novega Družinskega zakonika (DZ) je v primerjavi z ZZZDR prinesla razmejitev strokovne svetovalne in podporne vloge CSD od razsojanja, ki je v pristojnosti sodišča. Okrožno sodišče z uvedbo DZ odloča o ukrepih za varstvo otrokove koristi ter o skupni vzgoji in varstvu otroka. CSD pa poda strokovno mnenje, izvaja ukrepe in nadzor nad ukrepi ter izdela načrt pomoči družini in obvešča okrožno sodišče o izvajanju ukrepov. DZ daje velik poudarek zaščiti otrokove koristi in narekuje potrebo po večjem medsebojnem sodelovanju med CSD in okrožnimi sodišči. Diplomsko delo izvirno predstavi razmejitev pristojnosti odločanja CSD in okrožnega sodišča v družinskih zadevah za varstvo otrokove koristi po novem DZ. Uporabljeni sta opisna in normativna metoda pri opredelitvi pravnih virov družinskega prava in značilnosti DZ, pri opredelitvi temeljnih pojmov in institutov ter razmerij med starši in otroki, pa tudi pri predstavitvi postopkov odločanja v DZ in ukrepov za varstvo otrokove koristi. S primerjalno metodo je predstavljen prenos odločanja s CSD na okrožno sodišče glede na določila DZ in predhodno veljavni predpis ZZZDR. Ugotovitve kažejo, da ureditev DZ z vzpostavitvijo jasne razmejitve odločanja med CSD in okrožnim sodiščem in s tem razmejitve socialnovarstvenih storitev zagotavlja boljše varstvo otrokove koristi. Nova ureditev je dolgoročno boljša in odpravlja omejitve necelovitega varovanja otrokove koristi po ZZZDR. Ne glede na začetne težave DZ je varstvo otrokove koristi bolje zagotovljeno

Abstract:The new Family Code (FC) separates the professional counselling and support services of the Social Work Centres (SWC) from the judgements passed by courts. Under the FC, the District Court determines what is in the best interest of the child and decides on the shared education and care for children. SWC's pass their expert opinions, carry out measures and supervision, draw up plans to help the family and notify the competent court. The FC highlights the need for stronger cooperation between SWC's and District Courts. The thesis shows how the FC divides the power of passing orders and decisions between SWC's and District Courts in family-related matters. The thesis uses the descriptive and normative method to present family law sources, the FC, its terms and institutes, present the relations between parents and children, outline the decision-making procedures imposed by the FC and present the measures aimed to protect the child's interests. A method of comparison is used to present the transfer of decision-making from SWC's to District Courts in compliance with the FC and the former ZZZDR. The FC sets a clear division of powers between SWC's and District Courts in terms of separation of social care services and acts in the best interests of children. The new regulation sets up a system that is better in the long term and eliminates the limitations of incomprehensive protection of children's interests under the ZZZDR. Despite certain issues, the FC imposes better protection of children's interests
