Abstract: | Diplomsko delo obravnava dedovanje posebnega premoženja zakoncev. To področje urejata družinsko pravo in dedno pravo; pravico do dedovanja (in zasebne lastnine) pa omenja tudi Ustava RS. Slovenski pravni red izenačuje pravni položaj zakoncev z zunajzakonskimi partnerji in istospolnimi partnerji iz sklenjene in nesklenjene partnerske zveze. S primerjalno metodo raziskovanja je avtor ugotovil, da nekateri pravni redi njihov pravni položaj urejajo tudi drugače. Premoženje zakoncev se po DZ deli na skupno in posebno premoženje (zakoniti premoženjski režim), razen če zakonca svoja premoženjska razmerja uredita drugače z ženitno pogodbo (pogodbeni premoženjski režim), ki jo je uveljavil ravno DZ leta 2017. V primerjalnem pravu poznamo več različnih premoženjskih režimov. Dedni delež zakonca je najprej odvisen od tega, ali je zapustnik napisal oporoko ali ne. Zatem pa tudi od tega, ali deduje v prvem ali drugem dednem redu in koliko potomcev ali prednikov je zapustil zapustnik. V prvem dednem redu deduje poleg zapustnikovih potomcev po enakih delih, v drugem dednem redu pa poleg zapustnikovih prednikov polovico zapuščine. Zakonec nima dedne pravice, če pride še pred zapustnikovo smrtjo do trajnega prenehanja življenjske skupnosti. Sodna praksa si ni enotna glede vprašanja, ali ima v takšnem primeru dedno pravico morebitni zapustnikov zunajzakonski partner, čeprav ZD določa, da se takšno razmerje ne šteje kot zunajzakonska skupnost, saj je odsotnost sklenjene zakonske zveze eden od pogojev za veljavnost zunajzakonske skupnostiThis thesis deals with the inheritance of the spouses' separate property. These matters concern family law and law of succession. The inheritance rights (as well as the right to private property) are also mentioned in the Constitution of the Republic of Slovenia. The Slovenian legal order equates the legal position of spouses with the legal position of non-marital partners and same-sex partners in registered and non-registered civil partnerships. Using the method of comparison, it was found that some legal orders manage their legal position differently. According to the family code, the spouses' property is divided into community property and separate property (legal matrimonial property regime), unless the spouses had managed their property relations differently by signing a marriage contract (contractual matrimonial property regime), which was enacted by the family law in 2017. Comparative law deals with several different property regimes. Firstly, the portion of the estate that the surviving spouse inherits depends on whether the deceased had written the will or not. It also depends on whether the surviving spouse inherits the property by the first or the second order of inheritance, as well as on how many descendants or ancestors the deceased had. The first order constitutes that the decedent's children and the spouse inherit in equal shares, and the second order of inheritance constitutes that the spouse inherits a half of the estate, while the decedent's ancestors inherit the other half. The surviving spouse does not have the right to inherit if legal separation had taken place prior to the decedent's death. In this instance, the case law is not consistent on the question of whether a potential decedent's non-marital partner has the right to inherit or not, even though family law stipulates that this kind of relationship is not considered a consensual union, as not being married is one of the conditions for the validity of a consensual union |
