Title:Je ISIS država? : diplomsko delo

Abstract:V diplomskem delu je predstavljeno, kaj je ISIS in opredelitev vprašanja, ali je ISIS oz. danes IS, priznana kot država. 1. člen Montevidejske konference določa štiri kriterije za nastanek nove države. To so prebivalstvo, ozemlje, lastna vlada in sposobnost sodelovanja z drugimi državami. Pri nastajanju držav pa ima prav tako zelo pomembno vlogo mednarodno pravo, ki pa ga ISIS pravno ne upošteva. V prvem delu diplomske naloge so postavljene tri hipoteze, ki bodo s pravno analitično metodo potrjene ali zavržene. V osrednjem delu je predstavljen pojem mednarodnega prava in zakaj je pomemben pri nastajanju novih držav. Opisana so načela mednarodnega prava, na katerih temelji mednarodni red in jih morajo spoštovati vse države v mednarodnih odnosih. Prav tako je opisano, katere kriterije država potrebuje za nastanek in kako se prizna novo nastalo državo. V osrednjem delu je predstavljena tudi ISIS, in sicer kako je nastala in se skozi zgodovino razvijala. Opredeljeno je, od kje se ISIS financira, kaj je njen cilj, s čim dosegajo svoje cilje in kako izvajajo medijsko propagando za pridobivanje novih pripadnikov. Za dosego svojih ciljev uporabljajo tudi terorizem, s katerim pa kršijo človekove pravice. V nadaljevanju je zato predstavljen tudi pojem terorizma, njegove značilnosti in kršenje človekovih pravic. Ker pa terorizem krši mednarodno pravo, je opisano tudi, kako se mednarodna skupnost bori proti terorizmu in kršenju človekovih pravic. Evropski parlament je sprejel številne resolucije na temo človekovih pravic in Islamske države. V okviru opredeljenih resolucij Evropskega parlamenta je v zadnjem delu diplomskega dela opravljena pravna analitična metoda

Abstract:The diploma thesis presents what ISIS is and the definition of the question of whether ISIS is recognized as a state. 1. Article Montevideo Conference sets out four criteria for the creation of a new state.These are a population, a defined territory, government and the capacity to entire into relations with other states. International law is very important role in the creation of states, which ISIS does not legally take into account. In the first part of the diploma thesis, 3 hypotheses are set, which will be confirmed or rejected by a legal analytical method. The central part presents international law and why it is important in the creation of new states. The principles of international law on which the international order is based are described and must be respected by all states in international relations. It also describes what criteria a country needs to form and how a newly formed state is recognized. The central part also presents ISIS. It defines where ISIS is funded from, what their goal is and how they carry out media propaganda to gain new members. They use terrorism to achieve their goals, which violates human rights. However, as terrorism violates international law, it also describes how the international community fights terrorism and human rights violations. The European Parliament has adopted a number of resolutions on human rights and the Islamic State. In the context of the defined resolutions of the European Parliament, the legal analysis method is performed in the last part
