Title:Obličnost pogodbenih razmerij in teorija o realizaciji : diplomsko delo

Abstract:Diplomska naloga obravnava pravno ureditev obličnosti in teorije o realizaciji. Naloga je zasnovana v dveh delih, teoretičnem in empiričnem. Teoretični del naloge zajema več uporabljenih metod, in sicer analizo primarnih in sekundarnih virov, deskripcije in sinteze, na podlagi katerih je v diplomski nalogi predstavljena pravna ureditev obličnosti na splošno, zgodovinski razvoj, namen posebej zahtevanih obličnosti ter pregled pogodb, urejenih v OZ, za katere se zahteva posebej predpisana obličnost. V nadaljevanju je predstavljena teorija o realizaciji, njen razvoj in način uporabe. Empirični del je usmerjen v kvalitativno raziskovanje, na podlagi katerega je predstavljeno, na kakšen način sodišča uporabljajo teorijo o realizaciji. Namen in cilj raziskave je predstaviti in raziskati obličnost ter razloge, zaradi katerih pravna ureditev predpisuje obliko, hkrati pa tudi podrobneje raziskati teorijo o realizaciji s pomočjo sodne prakse, z namenom pridobiti jasno sliko o tem, kako se teorija o realizaciji lahko v praksi dejansko uporabi. Na podlagi sekundarnega raziskovanja študije gradiv in pregleda sodb na področju teorije o realizaciji ugotovitve v empiričnem delu kažejo, da sodišča teorijo o realizaciji še danes veliko uporabljajo, podrobnejše ugotovitve pa so predstavljene v sami diplomski nalogi

Abstract:The thesis deals with the legal regulation of formality and the theory of realization. It is designed in two parts, theoretical and empirical. The theoretical part of the thesis includes several methods used, namely analysis of primary and secondary sources, description and synthesis, on the basis of which the thesis presents the legal regulation of formality in general, historical development, purpose of specially required forms, and review of contracts regulated in OZ, for which a specially prescribed form is required. The theory of realization, its development and method of application are presented below. The empirical part is focused on qualitative research, on the basis of which it is presented how courts use the theory of realization. The purpose and aim of the research is to present and investigate the form and reasons why the legal system prescribes the form, and at the same time to investigate the theory of realization in more detail with the help of case law, in order to get a clear picture of how the theory of realization can be used in practice. Based on secondary research, studies of materials and a review of judgments in the field of theory of realization, findings in the empirical part show that the courts still use the theory of realization. More detailed findings are presented in the thesis
