Title:Odgovornost koncedenta za škodo : diplomsko delo

Abstract:Na podlagi rezultatov opravljenega raziskovanja in še zlasti glede na analizo veljavne zakonodaje in strokovnih prispevkov ekspertov z obravnavanega področja smo potrdili obe hipotezi te diplomske naloge. Nedvomno je, da je koncesionar odgovoren za škodo, povzročeno uporabnikom in drugim osebam, ki neupravičeno utrpijo škodo zaradi delovanja (ali opustitve dolžnega ravnanja) koncesionarja pri oziroma ob izvajanju javne službe. Koncesionar ima obveznost zagotavljati uporabnikom dobrin in storitev javnih služb vse javne dobrine in javne storitve in če pri tem uporabnikom nastane škoda, je tudi logično, da koncesionar odgovarja primarno in neposredno (tudi za svoje zaposlene delavce). Na drugi strani pa je % zaradi številnih razlogov % logično, da odgovarja tudi koncedent, ki je podelil koncesijo koncesionarju, vendar zgolj subsidiarno, zlasti, kot to določa tudi Zakon o javno-zasebnem partnerstvu, ko je jasno, da uporabniki ne bi mogli priti do odškodnine neposredno od koncesionarjev, ali bi to bilo precej oteženo. Pri tem, po našem mnenju, po slovenskem pravu ni mogoča drugačna oblika odškodninske odgovornosti koncedenta, kakor je to oblika subsidiarne odgovornosti za škodo, ki jo povzroči koncesionar oziroma pri njem zaposlene osebe

Abstract:Based on the results of the research and especially with regards to the analysis of the current legislation and professional contributions of experts in the field, I confirmed both hypotheses of this thesis. There is no doubt that the concessionaire is liable for damages caused to the users and other persons who unjustifiably suffer damages as the result of the concessionaire's performance (or failure to act) in the execution of the public services. The concessionaire has an obligation to provide users of public goods i.e. public services with public goods and public services, and if this causes damages to the users, it is also logical that the concessionaire is primarily and directly liable (including for his employees). On the other hand, for a number of reasons, it is logical that the grantor (koncedent) who entered into the relationship with the concessionaire is also liable, but only in the form of subsidiary liability, especially when stipulated by the Slovenian Law on Public-Private Partnership (when it is clear that the users cannot get compensation directly from the concessionaire, or this would be rather difficult). In my opinion, according to Slovenian public law, the form of liability of the grantor (koncedent) can be only the form of subsidiary liability for damages caused by the concessionaire or persons employed by him
