Title:Razvoj mednarodnega prava nadzračnega prostora : diplomsko delo

Abstract:V diplomski nalogi želimo bralcem predstaviti mednarodnopravni razvoj prava nadzračnega prostora in njegov pomen za sodobno družbo. V prvem delu predstavljamo zgodovinski okvir, ki je pripeljal do poznavanja formalnih pravnih virov nadzračnega prostora in načel, ki se v mednarodnem prostoru implicirajo skupaj z uporabo doktrine res communis omnium. V osrednjem delu pozornost namenjamo tematiki nacionalnih pravnih sistemov, njihovem vplivu in pravni urejenost nacionalnih prav posameznih držav na področju prava nadzračnega prostora. Opisujemo, kako sta na razvoj prava nadzračnega prostora vplivali vesoljska zakonodaja in vesoljska politika. Predstavljamo pomen tako imenovane vesoljske diplomacije, ki se je razvila v zadnjih petdesetih letih in postaja v sodobni družbi vse bolj pomembna. Ker je področje prava nadzračnega prostora še dokaj neraziskano in ker ne vemo, kakšna pravna vprašanja bo potrebno reševati v prihodnje, v diplomskem delu opisujemo tudi tehnike reševanja sporov na področju prava nadzračnega prostora. V zadnjem delu predstavljamo razvojne tematike in prihodnost, ki naj bi čakala pravno skupnost. Bomo nekoč z razvojem tehnologije lahko prav vsi potovali v vesolje? Bo zaradi napredka tehnologije in stremenja človeštva k odkrivanju novih skritih delov nadzračnega prostora potrebno posodobiti, spremeniti ali razviti nove formalne pravne vire v mednarodni skupnosti?

Abstract:With the diploma thesis we want to present to the readers the international legal development of the law of the space and its significance for modern society. The first part will present the historical framework that led to the knowledge of the formal legal sources of the space and the principles that are implied in the international space together with the application of the doctrine of res communis omnium. In the central part, we will pay more attention to the topic of national legal systems, what is the impact and what is the legal regulation of national laws of individual countries in the field of space law. How the development of space law has been influenced by space legislation and space policy. I will present the importance of so-called space diplomacy, which has developed in the last fifty years and is becoming increasingly important in modern society. As the field of space law is still relatively unexplored and we do not know what legal issues will need to be resolved in the future, part of the diploma thesis also describes the techniques for resolving disputes in the field of space law. In the last part, development topics and the future that awaits the legal community will be presented. Will we ever be able to travel into space with the development of technology? Will it be necessary to modernize, change or develop new formal legal sources in the international community due to advances in technology and the aspiration of humanity to discover new hidden parts of the space?
