Title:Analiza in ocena obsodbe Slovenije pred ESČP v zadevi varčevalci Ljubljanske banke : magistrsko delo

Abstract:Od razpada Socialistične federativne Republike Jugoslavije je preteklo že kar nekaj časa, pa vendar se še vedno dogovarja ter rešuje nedokončane obveznosti med državami naslednicami. Mednje tako sodi tudi dogovor o dodelitvi obveznosti, sprejetih v Sporazumu o vprašanjih nasledstva, v zvezi z deviznimi hranilnimi vlogami. Ob odsotnosti dogovora so varčevalcem vloge ostale nerazpoložljive za obdobje več kot dvajset let, kar je povzročilo kršitev človekove pravice do varstva premoženja. Temelj magistrskega dela predstavlja analiza in ocena sodbe Evropskega sodišča za človekove pravice v zadevi Ališić in dva druga proti Bosni in Hercegovini, Hrvaški, Srbiji, Sloveniji in Nekdanji jugoslovanski republiki Makedoniji. Za vpogled v okoliščine primera so bile analizirane Konvencija o varstvu človekovih pravic in temeljnih svoboščin, pravica do varstva premoženja ter sodna praksa na tem področju, Sporazum o vprašanjih nasledstva, bančni sistem SFRJ ter primer bančnega sistema v tržnem gospodarstvu. Na podlagi naštetega je bilo zaključeno, da ni mogoče oporekati dejstvu, da je bila v dani situaciji kršena človekova pravica do varstva premoženja. Z analizo in oceno sodbe je bilo ugotovljeno, kakšen vpliv prinaša sodba na stanje Sporazuma o vprašanjih nasledstva ter kakšne učinke prinaša na sodno prakso ter mednarodno pravo. Hkrati pa je bilo utemeljeno, ali bi z upoštevanjem mednarodnopravnih razmerij bila razsodba Sodišča ugodnejša za Republiko Slovenijo. Nazadnje pa je bilo podano, na kakšen način je potekala implementacija sodbe ter ali so bili izpeljani ukrepi ustrezni

Abstract:From the dissolution of the Socialist Federal Republic of Yugoslavia has passed quite some time, but there are still unresolved obligations between successor states, which needs to be negotiated. These unresolved obligations also contain the agreement for allocation of commitments made in Agreement on Succession Issues, in relation to foreign currency deposits. Because of the absence of the agreement, deposits of the savers were unattainable for a period more than twenty years, which caused a violation of the human right to the protection of property. The basis for the master`s thesis is the analysis and evaluation of the European Court of Human Rights judgment, in the case of Ališić and two others against Bosnia and Herzegovina, Croatia, Serbia, Slovenia and the Former Yugoslav Republic of Macedonia. For the insight into the circumstances of the case, the Convention for the Protection of Human Rights and Fundamental Freedoms, the right to the protection of the property and case law regarding this right, the Agreement on Succession Issues, the SFRY banking system, and banking system of one market economy, were analysed. On the basis of which, it was concluded, that the fact, that in the given situation the human right to the protection of property had been violated, could not be disputed. The analysis and the evaluation of the judgement established the impact that the judgement has on the status of the Agreement on Succession Issues and also the effects it brings on the case-law of the Court and international law. At the same time, it was justified whether, by taking into account international relations, the Court`s ruling would be more favourable for the Republic of Slovenia. In conclusion, the manner in which the judgement was implemented and whether the measures taken were appropriate, were stated
