Title:Organizacija združenih narodov kot dejavnik miru in varnosti : magistrsko delo

Abstract:Organizacija združenih narodov je organ, katere glavni namen je varovati mednarodni mir in varnost. Želja je skrbeti za kolektivno varnost vseh držav članic, ki so podpisnice Ustanovne listine OZN. Najpomembnejšo vlogo pri ohranjanju miru in varnosti ima Varnostni svet, natančneje stalne članice, ki imajo poseben položaj, saj imajo države stalno članstvo ter pravico do veta. Nesoglasje ali nepripravljenost stalnih članic je posledica, da do odločitev ali posega mednarodne skupnosti ne pride, čeprav bi bil tak poseg nujen. Zaradi nesoglasja med stalnimi članicami je Generalna skupščina sprejela resolucijo Združeni za mir, ki določa, da ima Generalna skupščina možnost, da se sestane na nujnem posebnem zasedanju in priporoči kolektivne ukrepe. Namen resolucije je, da bi se v prihodnje izognili problemom, to je nasprotovanju med stalnimi članicami Varnostnega sveta. Generalna skupščina je večkrat obravnavala vprašanja in sprejemala resolucije, ki posredno priporočajo ravnanje Varnostnemu svetu. Iz tega lahko vidimo, da je Generalna skupščina pomemben organ, pristojen za varovanje mednarodnega miru. Države članice morajo spoštovati Ustanovno listino, v kateri je določeno, da je prepovedano uporabiti silo, hkrati pa pojasni, katere so pravno dopustne oblike uporabe sile. Država lahko izvaja oborožene ukrepe, vendar mora biti resolucija avtorizirana s strani Varnostnega sveta. Če do vojaških ukrepov pride brez avtorizacije, pa je naloga OZN, da vzpostavi mirovno operacijo, hkrati pa pozove stranke v sporu, naj prenehajo z ogrožajočimi nevarnostmi in naj spor poskušajo rešiti na miren način. Raziskovalne metode, ki smo jih uporabili v magistrskem delu, so analiza in interpretacija ter zgodovinsko-razvojna, primerjalna in opisna metoda

Abstract:The United Nations (or the UN) is an organisation whose main purpose is to safeguard international peace and security. Its intention is to ensure the collective security of all its Member States - countries that are signatories to the Charter of the United Nations. The most important role in maintaining peace and security is entrusted to the Security Council, in particular the permanent Member States who hold a special position within the UN due to their permanent membership and their right to veto. Disagreements between the permanent Member States or their unwillingness to support a particular cause prevents the UN from intervening in the international community, even in times when such an intervention would be necessary. To circumvent the disagreements between Member States, the General Assembly adopted the resolution called United for Peace which stipulates that, when necessary, the General Assembly can convene in an urgent special session and recommend collective action. The purpose of the resolution is to avoid future problems and alleviate adversity between the permanent Member States of the Security Council. The General Assembly has repeatedly addressed issues and adopted resolutions that indirectly recommend action to the Security Council. This indicates that the General Assembly plays a crucial part in maintaining and safeguarding international peace. The Member States are required to respect the UN Charter which prohibits the use of force and determines the exceptions and cases where the use of force is legally permissible. Although countries may take military action, such a response must be authorised by the Security Council. However, if an unauthorised military action takes place, it is the task of the UN to establish a peacekeeping operation and call on the parties to the conflict to cease hostilities and try to resolve the dispute peacefully. The researching methods used in this master%s thesis are as follows: analysis and interpretation, the historical-development method, the comparative method, and the descriptive method
