Title:Pomembnost otrokovega mnenja pri odločanju o skrbništvu, kadar pride do razveze zakonske zveze : diplomsko delo

Abstract:Družina je življenjska skupnost staršev in otrok, ki zaradi koristi otrok uživa posebno varstvo. Zakonska zveza temelji na svobodni odločitvi skleniti zakonsko zvezo, na obojestranski čustveni navezanosti, vzajemnem spoštovanju, razumevanju, zaupanju in medsebojni pomoči. Iz različnih razlogov včasih zakonske zveze ni mogoče obdržati in tako tudi ne družine. V večini primerov se zakonca dogovorita glede skrbništva in vseh drugih vprašanj, vezanih na vzgojo in varovanje otrok. Včasih pa to ni mogoče, zato takrat posreduje sodišče, katerega glavna naloga je varovati koristi otroka. Pri tem sodišče upošteva mnenje centra za socialno delo, prav tako pa tudi mnenje otroka, če ga je otrok izrazil sam ali po osebi, ki ji zaupa in jo je sam izbral, in če je sposoben razumeti njegov pomen in posledice. Otroci se pogosto ne zavedajo, kako pomembne odločitve bodo sprejete zanje, zato je naloga javnega organa (sodišča) in zagovornika otrok, da poskrbi, da je otrok informiran in vključen v postopek. V tej nalogi bomo poskušali odgovoriti na vprašanje, kolikšno težo ima mnenje otroka pri odločanju, in ali naj bi postala praksa vsakega otroka vprašati za mnenje. Poskušali bomo tudi ugotoviti, kolikšno odgovornost imajo klinični psihologi pri pridobivanju otrokovega mnenja

Abstract:The family is a living community of parents and children who enjoy special protection for the benefit of the children. Marriage is based on the free decision to marry, mutual emotional attachment, mutual respect, understanding, trust and mutual help. For various reasons, it is sometimes not possible to maintain a marriage and thus maintain a family. In most cases, the spouses agree on custody and all other issues related to children's upbringing and protection. Sometimes, however, this is not possible. Then the court intervenes, its main task being to protect the interests of the child, taking into account the opinion of the Social Care Centre as well as the opinion of the child if expressed by himself or by a person he trusts and has chosen himself and if he is able to understand its meaning and consequences. Children are often unaware of how important decisions will be made for them, so it is the public authority's (court) task and the children's advocate to ensure that the child is informed and involved in the proceedings
