Title:Modus operandi radijskih izdajateljev v praksi po pridobitvi dovoljenja za izvajanje radijske dejavnosti in statusa programa posebnega pomena v Republiki Sloveniji v obdobju 2004-2014 : magistrska naloga študijskega programa druge stopnje

Abstract:Pričujoča magistrska naloga se ukvarja s strokovnim področjem izdanih radijskih dovoljenj in dodeljenih statusov radijskega programa posebnega pomena v okviru radiodifuzne dejavnosti v Republiki Sloveniji. Zakonsko-regulatorna ureditev zadevnega področja določa, da morajo v skladu z Zakonom o medijih radijski izdajatelji za namen izvajanja radijske dejavnosti naprej priglasiti svoj medij v razvid medijev pri Ministrstvu za kulturo, šele nato lahko od Agencije za komunikacijska omrežja in storitve Republike Slovenije in Sveta za radiodifuzijo kot soregulatorjev pridobijo radijsko dovoljenje. V okviru razširjanja in oddajanja programskih vsebin lahko ob izpolnjevanju pogojev pridobijo tudi status radijskega programa posebnega pomena. Z lastno analizo sekundarnih podatkov v obliki dokumentov (zlasti izdanih odločb in sklepov) soregulatorjev v zvezi z radijskimi dovoljenji in zadevnimi statusi ter izvedenimi strokovnimi nadzori nad radijskimi izdajatelji v obdobju 2004–2014 smo poskušali definirati pristop oziroma t. i. modus operandi radijskih izdajateljev v vsakodnevni praksi radijskega delovanja, ko so le-ti pridobili zadevna dovoljenja in statuse. Na podlagi izvedene analize ugotavljamo, da izdajatelji relativno pogosto spreminjajo zahteve in omejitve, ki izhajajo iz dovoljenj, prav tako se odločajo za prenos pravice za izvajanje radijske dejavnosti na drugo pravno osebo. V zvezi z ugotovljenimi kršitvami radijski izdajatelji v večini upoštevajo urejevalne ukrepe regulatorja in odpravijo nepravilnosti, navkljub temu pa je regulator v proučevanem obdobju v desetih primerih začasno preklical in odvzel bodisi radijska dovoljenja bodisi statuse. Ob zaključku na podlagi ugotovitev podajamo potencialne predloge za namen izboljšanja stanja na proučevanem področju in predlog za nadaljnje raziskovanje analiziranega predmeta.

Abstract:This thesis dealt with the subject matter of issued radio licences and the issued status of radio programming services of special importance within the framework of broadcasting activity in the Republic of Slovenia. Legislative regulation in this area stipulates that, in accordance with the Mass Media Act, in order to carry out broadcasting activity a radio broadcaster must first register its medium on the Mass Media Register at the Ministry of Culture, after which it may receive a licence for carrying out radio activities from the co-regulators, namely the Agency for Communication Networks and Services of the Republic of Slovenia and the Broadcasting Council. Within the framework of programme content dissemination activities, a radio broadcaster may (if criteria are met) acquire the status of radio programme services of special importance. We analysed secondary data (co-regulators’ issued rulings and decisions) relating to radio licences and the aforementioned status, as well as expert supervision of radio broadcasters, during the period of 2004-2014. We attempted to discern the modus operandi of radio broadcasters in everyday practice of radio broadcasting activities after acquisition of the aforementioned licences and status. On the basis of the analysis carried out herein, we found that broadcasters relatively frequently changed programme requirements and restrictions that follow on from their licences and decided to transfer the radio broadcasting licence onto other legal entities. In relation to the observed violations, radio broadcasters for the most part observed the regulator’s rulings and rectified irregularities. Despite this, the regulator temporarily cancelled or withdrew radio licences or status from ten broadcasters during the studied period. In conclusion, on the basis of these findings we propose ideas for improving the state of affairs in the studied area and suggest future directions for research of the analysed subject matter.
