Title:Opredelitev terorizma v dokumentih OZN in EU po letu 2001 : magistrsko delo

Abstract:Terorizem je grožnja mednarodnemu miru in varnosti. Najhujši teroristični napad se je zgodil 11. 9. 2001 v ZDA, v katerem je umrlo skoraj 3.000 ljudi. Svet se je takrat pričel zavedati, da terorizem predstavlja grožnjo celotni civilizaciji in ne le posamezni državi, kot je to veljalo v polpreteklosti. Pojem terorizma je obenem dobil popolnoma drugačen pomen. Mednarodna raznolikost in različni interesi onemogočajo sprejetje enotne definicije terorizma tako v OZN kot na ravni EU. Terorizem lahko najbolj preprosto opredelimo kot uporabo ali grožnjo z uporabo nasilja proti določenim subjektom za dosego določenih političnih ciljev. Vsem dobro poznana izjava %za nekoga terorist, za drugega borec za svobodo% je ena od največjih ovir globlje opredelitve terorizma. Znotraj OZN je bil ustanovljen VS, ki ima primarno nalogo ohranjanja mednarodnega miru in varnosti. Izpostaviti velja, da je VS OZN pri zagotavljanju svetovne varnostni manj učinkovit prav zaradi načina glasovanja v njem, vendar kljub temu relativno dober, kajti preprečuje, da bi se stalne članice VS OZN, ki so svetovne velesile, spopadle med seboj. EU postavlja temelje boja proti terorizmu že v preambuli PEU. Sprejemanje dokumentov OZN in EU je najpogosteje odziv na aktualne razmere, posledice terorističnih napadov. Ugotovitve kažejo, da je ustroj organov EU bistveno bolj operativen in učinkovitejši kljub dejstvu, da EU določene pravne akte povzema ali implementira v svoj pravni red od OZN. EU kljub temu nima enotne definicije terorizma, četudi zastopa interese držav, ki so si bistveno bolj podobne v ureditvi političnega sistema, kakor tudi na gospodarskih, kulturnih, verskih in drugih področjih

Abstract:Terrorism is a threat to international peace and security. The most devastating terrorist attack happened on September 11th 2001 in the USA, where almost 3.000 have died. It was this moment, when the world became aware that terrorism represents a threat to the entire civilization, not only to a single country, as this was the case in the halfpast. The concept of terrorism also got a completely different meaning. International diversity and different interests make it impossible to adopt a uniform definition of terrorism at the UN as well as EU level. Terrorism can be most easily defined as the use or threat of the use of violence against certain subjects in order to achieve certain political goals. The well-known statement %One man's terrorist, another man's freedom fighter% is one of the greatest obstacle for a deeper definition of terrorism. Within the UN, the UNSC was established with the primary task of maintaining international peace and security. It is worth noting that the UNSC is less effective in providing global security mainly due to its voting system, but still relatively effective, since it prevents that permanent members of the UNSC, which are world powers, would attack each other. The EU is laying the foundations for the fight against terrorism already in the Preamble of TEU. The adoption of UN and EU documents is mostly a reaction to current circumstances; consequences of terrorist attacks. Findings show that the structure of EU bodies is significantly more operative and effective despite the fact that the EU reproduces certain acts from the UN and implements them into its own legal framework. However, the EU does not have a uniform definition of terrorism, even though it represents the interests of states, which are significantly more similar in terms of the political system as well as in the fields of culture, religion etc.
