Title:Prenos V. poglavja Direktive (EU) 2016/1148 v slovenski pravni red : magistrsko delo

Abstract:V sodobnem svetu se uporaba informacijskih sistemov in omrežij vseskozi povečuje in postajajo ključni za razvoj in uspešno rast gospodarskih in negospodarskih dejavnosti. Vedno hitrejši razvoj informacijsko-komunikacijskih tehnologij in uporaba informacijskih sistemov vpliva na naše življenje. Tehnološki razvoj pomeni večjo ranljivost in dovzetnost informacijsko-komunikacijskih sistemov za kibernetske napade, zaradi česar se je v zadnjem desetletju intenziteta boja proti kiberkriminalu povečala in izvaja se vse več aktivnosti, tako na evropski kot državni ravni. V magistrskem delu preučujemo te aktivnosti, s poudarkom na implementaciji V. poglavja Direktive (EU) 2016/1148 o ukrepih za visoko skupno raven varnosti omrežij in informacijskih sistemov v Uniji (Direktiva NIS) v IV. poglavje Zakona o informacijski varnosti (ZInfV). Zanima nas, ali so bile določbe prenesene v celoti in pravilno in ali novi zakon (že) vpliva na zmanjšanje števila kibernetskih napadov. To bomo raziskali s pomočjo različnih metod, ki slonijo na zgodovinskem pregledu, na analizi obstoječe in razpoložljive literature in zlasti na osnovi intervjujev. Poleg analize prenosa V. poglavja Direktive NIS v ZInfV želimo poudariti tudi pomembnost varnosti omrežij in informacijskih sistemov. Odgovornost za to nosijo posameznik, okolica, družba, država. Z delom želimo opozoriti, da načini za krepitev varnosti omrežij in informacij že obstajajo, treba jih je samo ozavestiti in jim dati najvišjo prioriteto

Abstract:In the modern world, the use of information systems and networks is constantly increasing and becoming crucial for the development and successful growth of economic and non-economic activities. The ever-increasing development of information and communication technologies and the use of information systems are affecting our lives. Technological development has increased the vulnerability and susceptibility of information and communication systems to cyberattacks, which has led to an increase in the intensity of the fight against cybercrime. The Master's thesis examines these activities, with emphasis on the implementation of Chapter V of Directive 2016/1148 on measures for a high common level of security of networks and information systems in the Union (NIS Directive) in Section IV. of the Information Security Act. We would like to know if the provisions have been fully and properly transposed and whether the new law (already) has the effect of reducing the number of cyber attacks. We will explore this through a variety of methods based on a historical overview, on an analysis of existing and available literature, and in particular through interviews. In addition, we also want to emphasize the importance of network and information system security. Responsibility for this lies with the individual, the surroundings, society, the state. We want to point out that the ways to enhance the security of networks and information already exist, they just need to be made aware and given the highest priority
