Title:Delo varuha človekovih pravic Republike Slovenije : diplomska naloga

Abstract:Problematika kršenja človekovih pravic nas spremlja že skozi zgodovino. Poleg pravic pa imajo ljudje tudi dolžnosti, ki jih morajo izpolnjevati, da bi bili upravičeni do pravic. Velikokrat so nam pravice kršene – predstavitev institucije, kot je Varuh človekovih pravic, je smiselno obravnavati v obliki diplomskega dela, saj nas poznavanje različnih prijemov ščiti, ko ostanemo nemočni in velikokrat brez potrebnega osnovnega znanja kako pristopiti pred državo ali sodstvo. Letno poročilo Varuha poroča o velikem številu kršitev na različnih področjih, kjer se srečuje z obupanimi ljudmi, ki trdijo, da državni organ krši njihove človekove pravice in temeljne svoboščine. Kljub varovalnim mehanizmom za zmanjšanje kršitev in ozaveščanje o pravicah in dolžnostih statistika kaže o določenem številu upravičenih pobud državljanov. Prvi sklop predstavlja teoretični del, ki sem ga razčlenila na šest poglavij. Prvo je splošni opis pravic in svoboščin človekova in državljana. Sledi poglavje, ki opisuje razvoj varuha človekovih pravic skozi zgodovino, v tretjem poglavju sledi postavitev človekove pravice v slovenski ustavni sistem. Četrto poglavje predstavlja institucijo varuha človekovih pravic Republike Slovenije. Peto poglavje je namenjeno delu varuha in področja katera pokriva. Šesto poglavje pa ponazarja kakšen je postopek izpolnjevanja obrazca za oddajo pobude Varuhu. Drugi sklop je namenjen empiričnemu delu, kjer s kvantitativno metodo že obstoječe reprezentativne ankete odgovorim na zastavljene hipoteze. Na koncu sledi razprava, kjer sem predstavila ugotovitve na podlagi javnomnenjske raziskave in podala kritično mišljenje.

Abstract:The issue of human rights abuses have accompanied us throughout history. In addition to the rights people have duties that we must fulfill in order to be entitled to rights. Many of our rights are violated. The presentation of institutions such as the Ombudsman, it seems to me reasonable to consider in the thesis, as we are understanding the different approaches to protecting when we remain powerless, and often without personal functional literacy when dealing with mighty country institutions or the judiciary. Annual Report of the Ombudsman shows large number of violations in various areas faced with hopeless people who claim that the national authority is in breach of their human rights and fundamental freedoms. Despite the protective mechanism to reduce violations and raise awareness of the rights and duties, statistics show high numbers of eligible citizens' initiatives. The first set represents theoretical part, broken down into six chapters. The first is a general description of the rights and freedoms of man and citizen. Next is a section which describes the development of the ombudsman through history. The third chapter is about human rights in the Slovenian constitutional system. The fourth chapter introduces the institution of the Ombudsman of the Republic of Slovenia. The fifth chapter is devoted to the work of the Ombudsman and the scope of which covers. The sixth chapter illustrates how the process of completing the form for submission of complaints to the ombudsman. The second part is devoted to the empirical part, where the quantitative method of already existing representative survey answers to the hypothesis. In the end is a debate of presented findings on the basis of opinion polls and personal critical thinking.
