Abstract:Magistrsko delo z naslovom »Praviri ustavnosti« se ukvarja z identifikacijo tistih značilnosti najzgodnejših pravnih virov, zaradi katerih lahko o teh virih lahko govorimo tudi kot o najzgodnejših ustavnih (pra)dokumentih, pri čemer je definicija ustave široka, saj jo razumemo kot vsak dokument, ki služi omejevanju (samo)volje oblasti. Pri delu sta uporabljeni metoda jezikovne analize ter metoda primerjave virov. Ključna ugotovitev magistrskega dela je, da že najzgodnejši pravni viri služijo omejevanju oblasti ter vsaj rudimentarnemu zagotavljanju načela enakosti pred zakonom. Sekundarno pa gre ugotoviti, da ti pravni dokumenti poznajo institute, ki so po svojem bistvu in namenu presenetljivo moderni. Očitno je namreč, da so pravno in politično gledano vse civilizacije postavljene pred isto težavo – kako omejiti moč nosilcev oblasti in zagotoviti, da ne prihaja do zlorab. Magistrsko delo je uporabno kot izhodišče za poglobljeno raziskovanje posameznega pravnega obdobja, saj zaradi svoje širine onemogoča podrobnejši pregled posameznega obdobja. Slednje je tudi omejitev magistrskega dela, saj je časovna razpršenost narekovala izbiranje pravnih virov, kar nujno pomeni, da izpadejo nekateri manj znani, a zato ne manj zanimivi in vplivni pravni viri.

Abstract:The master's thesis entitled "Ancient Sources of Constitutionalism” focuses on identification of characteristics of the earliest legal sources, which legally speaking enables study of those sources as the earliest constitutional documents. Definition of the constitution is broad as we consider constitution as any document, which intention is (self)limitation of the political powers. The methods used by master's thesis are language analysis and the method of comparing sources. The key finding of the master's thesis is that the earliest legal sources serve to limit power and at least rudimentary guarantee the principle of equality before the law. Secondly, it should be noted that these legal documents are introducing institutes that are surprisingly modern in their essence and purpose. It is obvious that, legally and politically speaking, that all civilizations are faced with the same problem - how to limit holders of power and prevent its abuse. The master's thesis is useful as a starting point for in-depth research of an individual legal period, as due to the breadth of the topic it prevents being a more detailed overview of an individual period. The latter also represents a limitation of the master's thesis, as the sheer dispersion of time observed dictated the choice of legal sources, which necessarily means that some less known, but no less interesting and influential legal sources are omitted.
