Title:Položaj žrtve nasilja pri urejanju preživnine za otroke : magistrsko delo

Abstract:Nasilje v družini prežema velik del slovenske družbe. V kar 90,8 % so povzročitelji nasilja moški. Oče kot povzročitelj nasilja ima starševsko dolžnost preživljanja svojih otrok. Družinski zakonik v 6. členu določa starševsko skrb kot celoto vseh obveznosti in pravic staršev, da v skladu s svojimi zmožnostmi ustvarijo razmere, v katerih bo zagotovljen celovit otrokov razvoj. Zakon o preprečevanju nasilja v družini pa izrecno ne opredeli neplačevanja preživnine kot oblike ekonomskega nasilja, omogoča pa subsumpcijo pod zadnji del zakonske opredelitve ekonomskega nasilja. Ob prisotnosti nasilja v družini je urejanje preživnine za otroke polno ovir, ki lahko celo pretehtajo nad uveljavljanjem otrokove pravice do preživnine. Ženska, ki je preživela nasilen odnos in zbrala moč za odhod, se zaradi doživljanja različnih oblik nasilja znajde v situaciji finančne, telesne in psihične izčrpanosti. Prostovoljnega plačevanja preživnine za otroke v primeru nasilja v družini skorajda ni mogoče pričakovati. Veliko verjetnejša je situacija nadaljevanja izvajanja ekonomskega nasilja nad otroki, ki tako postanejo neposredne žrtve nasilja s strani svojega očeta. Problematika urejanja preživnine za otroke je poleg psihofizičnih posledic preživetega nasilja tudi v dolžini sodnih postopkov, ki v povprečju trajajo sedem mesecev. Žrtev nasilja ima za čas trajanja postopka možnost vložitve predloga za izdajo začasne odredbe za pridobitev preživnine za otroke. Začasna odredba omogoča hitro ureditev spornega razmerja. Sodišča so z znižanjem pravnega standarda ogroženosti otroka ponovno vzpostavila zagotavljanje največje koristi otroka in se zavzela za spoštovanje starševske dolžnosti preživljanja otrok.

Abstract:Domestic violence is embedded in the majority of slovenian society. Quick glance at statistics shows us that a staggering 90.8% of perpetrators are male. In those cases the abuser has, as the father, a parental duty to support his children with child support. Article 6 of the slovenian family (matrimonial) law defines parental duty as a coherent whole of all obligations and rights of the parent(s) to, according to their capability, provide an environment with conditions in which the comprehensive development of the child will be ensured. Domestic Violence Prevention Act does not explicitly state that failure to pay alimony falls under economic violence, it does however, allow subsumption under the last part of the legal definition of economic violence. In the presence of domestic violence, arranging child support is full of obstacles that may even outweigh the exercise of a child’s right to maintenance. A woman who has survived a violent relationship and gathered the strength to leave is likely to find herself in a situation of financial, physical and mental exhaustion due to experiencing various forms of violence. Voluntary child support payments in the event of domestic violence are almost impossible to expect, much more probable is the continuation of economic violence against children, who thus become direct victims of violence by their father. In addition to the psychophysical consequences of surviving violence, the problem of arranging child support is also the length of court proceedings, which last on average seven months. The victim of violence has, for the duration of the proceedings, the opportunity to apply for an interim injunction to obtain child support. An interim injunction allows for a speedy settlement of the disputed relationship. By lowering the legal standard of endangering the child, the courts reestablished the provision of the best interests of the child, and advocated for respect for the parental duty of child support.
