Title:Avtohtonost kot merilo za status narodne manjšine in upravičenost do manjšinskih pravic : magistrsko delo

Abstract:Magistrsko delo obravnava merilo avtohtonosti v kontekstu statusa narodne manjšine in upravičenosti do manjšinskih pravic v Republiki Sloveniji. Država zagotavlja najvišjo stopnjo zaščite in manjšinskih pravic dvema avtohtonima, italijanski in madžarski narodni skupnosti. Pravice romske skupnosti so opredeljene z zakonom, preostale narodne in etnične skupnosti pa so upravičene do uživanja splošnih človekovih pravic in temeljnih svoboščin, med katerimi so enakost pred zakonom, pravice do izražanja narodne pripadnosti in uporabe svojega jezika in pisave ter prepoved diskriminacije. Avtohtonost je tisto (neopredeljeno) merilo, ki pri določanju upravičenosti posameznih manjšin do manjšinskih pravic igra ključno vlogo, saj omogoča avtohtonima narodnima skupnostma uživanje t. i. posebnih kolektivnih manjšinskih pravic. V uvodnem delu so opredeljeni temeljni pojmi, kot so narodne manjšine, manjšinske pravice in (mednarodno)pravno varstvo manjšin. V osrednjem delu magistrsko delo obravnava merilo avtohtonosti v kontekstu manjšinskih pravic; njegov vpliv na različne narodne oz. etnične skupnosti v Sloveniji; mnenja različnih mednarodnih in drugih teles o njegovem vplivu na status narodne manjšine in upravičenost do manjšinskih pravic; ter razlikovalno vlogo, ki jo ima v tem kontekstu merilo avtohtonosti. V zaključnem delu magistrsko delo obravnava še prihodnost varstva manjšin v Republiki Sloveniji v kontekstu pluralne in demokratične Evrope.

Abstract:The master's thesis deals with the criterion of autochthony in the context of the status of a national minority and entitlement to minority rights in the Republic of Slovenia. The state provides the highest level of protection and minority rights to two autochthonous national minorities – Italian and Hungarian. The rights of the Roma community are defined by special The Roma Community Act, and the remaining national and ethnic communities are entitled to the enjoyment of universal human rights and fundamental freedoms, including equality before the law, the right to express one's nationality and use one's language and script, and the prohibition of discrimination. Autochthonism is an (undefined) criterion that plays a key role in determining the eligibility of individual minorities or ethnic groups to minority rights, as it enables autochthonous national minorities and ethnic groups to enjoy so called special collective minority rights. The introductory part defines basic concepts such as national minorities, minority rights, domestic and international legal protection of minorities. In the central part, the master's thesis deals with the criterion of autochthony in the context of minority rights; its influence on various national or ethnic communities in Slovenia; opinions of various international and other institutions on its impact on the status of national minorities and entitlement to minority rights; and the distinctive role that the criterion of autochthony plays in this context. In the concluding part, the master's thesis deals with the future of the protection of minorities in the Republic of Slovenia in the context of a pluralistic and democratic Europe.
