Title:Odgovornost poslancev Državnega zbora : diplomsko delo

Abstract:Slovenija je mlada država, ki je postala suverena in neodvisna leta 1991. S prehodom v nov politični sistem se je na novo oblikoval parlament kot osrednji zakonodajni in predstavniški organ. Diplomska naloga opredeljuje odgovornost poslancev državnega zbora, kjer je poudarek namenjen sklicevanju na poslansko imuniteto, ki zagotavlja poslancem nemoteno in svobodno delovanje v dobro vseh državljanov. S tem, ko je zagotovljeno nemoteno delo poslancev, je posledično zagotovljeno nemoteno delo predstavniškega telesa. Rdeča nit naloge se vrti okoli vprašanja, ali je bila imuniteta v preteklosti vselej uporabljena upravičeno, ali so tudi zlorabljali sklicevanje nanjo in njeno podeljevanje. Podrobneje je predstavljeno tudi sklicevanje na poslansko imuniteto v posameznih mandatnih obdobjih, pravna ureditev poslanske imunitete in predlogi za spremembo 83. člena ustave. Pomembno novost glede dela poslancev je Etični kodeks poslancev, ki ima zametke že iz leta 1993 in je bil sprejet junija 2020. Besedilo kodeksa temelji na petih načelih. Ta načela so ugled in integriteta, lojalnost, pravičnost in poštenost, odgovornost – tudi okoljska ter dostojnost in spoštljivost. Naloga vključuje primerjalno pravni pristop, s katerim je prikazan način naše ureditve. Za primerjavo je predstavljen način uporabe imunitete v novonastalih evropskih državah. To so Hrvaška, Madžarska, Slovaška, Češka, Poljska in v državah, kjer je parlamentarni sistem že dlje prisoten: Italija, Grčija, Francija, Velika Britanija in Nemčija.

Abstract:Slovenia is a small country that became a postal sovereign in independence in late 1991. The predecessor in the new political system is now a new municipal parliament with accredited legislative and representative bodies. The diploma thesis defines the responsibility of deputies of the National Assembly, where the emphasis is on invoking parliamentary immunity, which ensures deputies to work smoothly and freely for the benefit of all citizens. By ensuring the smooth work of the deputies, the smooth work of the representative body was ensured. It is not a question of time when the law will come into force or if it is not approved by the court. It is about providing information regarding the provision of immunity in the case of a term of office of a period, a provision of the law of immunity in the case of a provision of 83 Member States. It will be released in November, which is part of the handling code. These principles include reputation and integrity, loyalty, fairness and honesty, responsibility - including the environment, and dignity and integrity. It is the primary property of the city and its name is the same as ours. First, the European Union will grant immunity in the new European countries; Croatia, Hungary, Slovakia, the Czech Republic, Poland and in countries with a longer parliamentary system; Italy, Greece, France, Great Britain in Germany.
