Title:Afriška unija – opis, način delovanja in problemi : magistrsko delo

Abstract:Magistrsko delo se osredotoča na Afriško unijo, opisuje njene organe in način delovanja ter varovanje človekovih pravic na celini, ki ga ureja Afriška listina o človekovih pravicah in pravicah ljudstev. Z ustanovitvijo Afriškega sodišča za človekove pravice in pravice ljudstev je bil storjen pomemben korak, saj se je začela razvijati sodna praksa, ki je pomagala pri reševanju konfliktov na nacionalni ravni. Metode, uporabljene v magistrskem delu, so metoda analize, s katero se je preučevala zakonodaja Afriške unije, in aksiološka metoda, s katero so se kritično ovrednotile pravne norme. Primerjava med organi in mednarodnimi telesi se je opravila s primerjalno metodo, sodnost se je preučevala s pomočjo metode in analize, kasneje pa še s pregledom sodne prakse, pri katerem se je ugotovilo, ali se pravna pravila odražajo tudi v praksi. Cilji, ki so bili doseženi v magistrski nalogi, so predstavitev načina delovanja organov Afriške unije in razlaga načina varstva človekovih pravic v Afriki, ki poteka na nadnacionalni ravni, za kar je pristojno Afriško sodišče za človekove pravice in pravice ljudstev. Izpostavljen je bil tudi odnos Afriške unije do drugih mednarodnih organizacij oziroma sui generis teles, kot sta OZN in EU – do OZN predvsem zaradi sodelovanja pri mirovnih misijah v Afriki in varstva človekovih pravic, do Evropske unije pa zaradi finančne pomoči, brez katere bi Afriška unija imela resne težave. Uporabnost ugotovitev magistrskega dela se kaže predvsem pri pomanjkanju literature o Afriški uniji v slovenskem jeziku. Omogoča boljši vpogled v delovanje unije, predstavlja njene probleme in omogoča razumevanje dogajanja na afriški celini.

Abstract:This master's thesis focuses on The African Union, describes its institutions and its organisation, and discusses the protection of human rights, regulated by the African Charter on Human and People's Rights. The methods used in this thesis are the method of analysis, used to study the legislation of The African Union, and the axiological method, used to critically evaluate the legal norms of the Union. The differences between The African Union bodies and international institutions were determined with the comparative method, judicial system was studied with the help of method and analysis and later by the review of case-law, where it was established whether legal rules were reflected in practise. The thesis aims to describe the functioning of the bodies/authorities of The African Union and to explain how the protection of human rights in Africa is managed on a transnational level under the jurisdiction of the African Court on Human and People’s Rights. It emphasizes the relation between The African Union and other international organisations or “sui generis” bodies such as the United Nations Organisation and the European Union. UNO is pointed out mainly for its participation in peace-keeping missions in Africa and its effort to protect human rights, and the European Union for its financial assistance that The African Union depends on heavily. The applicability of the findings of this thesis is mainly reflected in the lack of literature on The African Union in the Slovene language. Furthermore, it offers a better insight into the functioning of the Union, it emphasizes its challenges and provides a better understanding of the developments/events on the African continent.
