Title:Pravni pogled na kitajski Sistem javnega slovesa : magistrsko delo

Abstract:Množični videonadzor državljanov postaja stalnica vsakodnevnega življenja. Če smo še pred leti zgolj skomignili z rameni in tovrstno početje naprtili avtoritarnim sistemom, ki kršijo človekove pravice, pa je ravno aktualna koronakriza razgalila šibkost varovanja človekove zasebnosti, intime in primere, kako se (lahko) v imenu nacionalne varnosti opravičujejo posegi v vsakodnevno življenje ljudi. Razsežnosti, do katerih je prišlo na področju videonadzora v Ljudski republiki Kitajski, ki namerava s pomočjo sodobne tehnologije ne zgolj nadzirati družbo, temveč jo prevrednotiti po svojih nazorih, so težko predstavljive. In to praktično za vsako ceno. Namen magistrskega dela je bralcu razgaliti kitajski Sistem javnega slovesa, visokotehnološki sistem videonadzora, ki bo spremljal kitajske državljane pri njihovem vsakodnevnem življenju in vrednotil, kako se obnašajo, kaj počnejo, s kom se družijo in kakšen odnos imajo do vladajoče komunistične partije, potem pa bo to pretvoril v točke javnega slovesa, na podlagi katerih bo življenje Kitajcev bodisi lažje bodisi težje. Cilj magistrskega dela je problematiko sistema predstaviti čim bolj nepristransko. Prikazane so njegove prednosti in slabosti ter kaj se je iz njega mogoče naučiti, preden bo ideja o tovrstnem nadzorovanju in točkovanju ljudi neizbežno priromala na mizo evropskih zakonodajalcev. Dejstvo je namreč, da se tehnologija dandanes razvija z neverjetno hitrostjo, pravo pa le s težavo sledi hitro spreminjajoči se družbeni stvarnosti. Kljub temu pa to ni in ne sme biti izgovor, da se tehnologiji in vsakokratni vladajoči oblasti ne zarišejo meje, preko katerih ne smeta. Nezmožnost takšnega omejevanja namreč (lahko) vodi v hude absurde in kršitve temeljnih človekovih pravic, kot so razgaljene v magistrskem delu.

Abstract:Mass video surveillance of citizens is becoming a constant in everyday life. If years ago we just shrugged our shoulders and imposed this on authoritarian systems that violate human rights, the current corona crisis has revealed the weakness of protecting human privacy, intimacy and how, in the name of national security, it can justify interference in people's daily lives. Nowhere have they gone to such extremes in video surveillance as in the People's Republic of China, which intends not only to control society with the help of modern technology, but to revalue it according to its own views. At virtually any cost. The purpose of this master's thesis is to reveal to the reader the Chinese Social Credit System, a high-tech video surveillance system that will monitor Chinese citizens in their daily lives and evaluate how they behave, what they do, who they associate with and their attitude towards the ruling Communist Party. The collected data will then be turned into points of social credit, which will either make life easier or harder for Chinese people. The aim of the master's thesis is to present its problems as impartially as possible. It will show what its advantages and disadvantages are and what we can learn from it before the idea of such control and scoring of people inevitably lands on the table of European legislators. The fact is that technology is evolving at an incredible rate today, and the law is having difficulty following this rapidly changing social reality. Nevertheless, this is not and should not be an excuse not to draw the boundaries beyond technology and beyond the ruling government. The impossibility of such a restriction can lead to serious absurdities and violations of fundamental human rights, which will be exposed in present thesis.
