Title:Posvojitev in razveljavitev posvojitve : diplomsko delo

Abstract:V Sloveniji otroci uživajo posebno skrb in varstvo, kar izhaja že iz 56. člena Ustave Republike Slovenije, ki izpostavlja, da imajo otroci in mladoletne osebe, ki so ostale iz različnih razlogov brez staršev, posebno varstvo, ki jim ga zagotavlja država. Takšno varstvo predstavlja tudi posvojitev, ki predstavlja posebno obliko varovanja otroka, s katero nastane med posvojiteljem in otrokom enako razmerje kakor med roditelji in njihovimi potomci. Posvojitev je podrobneje predstavljena v nadaljevanju diplomskega dela. Na področju posvojitev je leta 2019 prišlo do nekaj sprememb in novosti, saj se je dne 15. 4. 2019 začel uporabljati Družinski zakonik, ki je nadomestil Zakon o zakonski zvezi in družinskih razmerjih. V Sloveniji je zelo malo otrok za posvojitev, kandidatov, ki so primerni, da postanejo posvojitelji pa vedno več, zato se v Sloveniji veliko več srečujemo z mednarodnim posvojitvami kot pa nacionalnim posvojitvam. Bistvo diplomskega dela je predstaviti celoten postopek posvojitve, ki se začne z oddajo vloge za posvojitev na center za socialno delo in konča z odločbo o posvojitvi, ki jo izda sodišče. O odločitvi posvojitve od leta 2019 odloča sodišče, pred tem pa je o posvojitvi odločal center za socialno delo

Abstract:Children in Slovenia have special protection and care, which is written in Article 56 of the Constitution of the Republic of Slovenia. Article 56 emphasizes that children and minors who have been left without parents for various reasons receive special state protection. Such protection is also represented by adoption, which represents a special form of childcare, which creates the same relationship between the adopter and the child as between the parents and their children. I presented the adoption in more details in the continuation of my diploma work. There were some changes and innovations in the field of adoptions in 2019, when the Family Code became valid on April 15 2019, replacing the Marriage and Family Relations Act. There are very few children for adoption in Slovenia and there are more and more candidates who are suitable to become adoptive parents, so in Slovenia we encounter international adoptions much more than domestic ones. The basis of diploma work is to present the entire adoption procedure, which begins with the submission of an application for adoption to the Center for Social Work and ends with the decision on adoption issued by the court. The decision on adoption has been decided by the court since 2019, before that the adoption was decided by the Center for Social Work
