Title:Določitev preživnine za otroka in pravne posledice neplačevanja preživninske obveznosti : diplomsko delo

Abstract:Vsak otrok, ki pride na ta svet, ima pravico do dostojnega življenja. Starši so tisti, ki morajo prvi poskrbeti, da bo otrok imel dovolj sredstev za preživetje in razvoj. V našem pravnem sistemu so starši v primeru ločenega življenja za svojega otroka dolžni plačevati preživnino. Otrokova korist je glavno vodilo, ki nas spremlja od določitve preživnine do njene izvršbe v primeru neplačevanja. Sodišča so varuhi otrokove koristi, zato mora vsaka določitev preživnine biti sodno potrjena. V primeru neplačevanja preživnine je upravičenec oz. zakoniti zastopnik dolžan sam uveljavljati zahtevke na podlagi pravice do preživnine. Prvi zahtevek je izvršba preživnine, nato sledi nadomestilo do preživnine in na koncu ovadba zaradi kaznivega dejanja neplačevanja preživnine. Glede na to, da vsak od teh postopkov zahteva določen čas, je najbolje vse zahtevke začeti takoj, ko se pojavi neplačevanje preživnine. Najbolj bistven del preživnine je, poleg njene primerne višine, njeno pravočasno plačevanje. Zelo pomembno je, da upravičenec ve, da vsak mesec lahko računa na preživnino. Vsako neplačevanje pušča na odnosu med zavezancem in otrokom posledice, ki lahko dolgotrajno vplivajo na njun odnos. Vsak starš je sam odgovoren za svoj odnos, ki ga ima s svojim otrokom. Z rednim plačevanjem preživnine zavezanec pokaže, da sprejema odgovornost, ki jo ima do svojega otroka

Abstract:Every child who comes into this world has the right to a dignified life. Parents are the ones who must be the first to make sure that the child has sufficient resources for survival and development. In our legal system parents are required to pay maintenance for their child in the event of a separate life. The best interests of the child are the main guide that accompanies us from the determination of maintenance to enforcement in the event of non-payment. The courts are the guardians of the child's best interests, so any determination of maintenance must be judicially confirmed. In case of nonpayment of maintenance, the beneficiary or the legal representative is obliged to assert claims on the basis of the right to maintenance. The first claim is the enforcement of maintenance, then compensation for maintenance and finally a complaint for the criminal offense of non-payment of maintenance. Given that each of these procedures requires a certain amount of time, it is best to start all claims as soon as non-payment of maintenance occurs. The most important part of maintenance is, in addition to its appropriate amount, timely payment. It is very important that the beneficiary knows that he can count on maintenance every month. Any non-payment leaves consequences on the relationship between the debtor and the child, which can have a lasting effect on their relationship. Each parent is responsible for their own relationship with their child. By paying maintenance regularly, the debtor shows that he accepts the responsibility he has towards his child
