Title:Reševanje gospodarskih sporov po izvensodni poti : diplomsko delo

Abstract:Alternativno reševanje sporov se nanaša na vsa sredstva za reševanje sporov zunaj sodne dvorane. Alternativno reševanje sporov običajno vključuje zgodnje nevtralno vrednotenje, pogajanja, spravo, mediacijo in arbitražo. Zaradi naraščajočih sodnih čakalnih vrst, naraščajočih stroškov postopka in časovnih zamud postaja tovrstno reševanje vse pogostejši način reševanja gospodarskih sporov. Ključno pri reševanju konfliktnih situacij, v katerih se znajdejo gospodarske družbe, je predvsem hitrost postopka, zaupnost, večja fleksibilnost in pristop, ki bo strankam omogočil predvsem nadaljnje sodelovanje. Najpogostejši metodi, ki jima bomo v zaključni nalogi namenili največ pozornosti, sta mediacija in arbitraža. Arbitraža je bolj formalna oblika od mediacije, v veliki meri pa nas spominja na poenostavljeno različico sodnih postopkov. V primerjavi s tradicionalnimi sojenji najdemo razlike v hitrejši izvedbi samega postopka, je manj formalna, videli pa bomo tudi, kakšni so stroški enega in drugega postopka. Mediacija je za fizične in pravne osebe tako priljubljena zaradi svoje fleksibilnosti, nadzora postopka, ki ga imajo stranke, zaupnosti, predvsem pa zato, ker ohranja odnose. Ključno vlogo med samim postopkom odigra mediator s svojimi tehnikami in metodami, zaradi katerih lahko spreminja dinamiko postopka. V nadaljevanju bomo videli predstavljeno tudi sodišču pridruženo mediacijo, ki se, kot že samo ime pove, izvaja na posameznih sodiščih. Sodišča s tovrstno mediacijo strankam nudijo možnost, da se spor reši tudi na manj formalen način. Da bi vsa navedena dejstva podkrepili z dokaznim gradivom, je v zaključnem delu predstavljena še statistika, koliko gospodarskih sporov je napotenih na mediacijo, v kakšnem številu soglasje podata obe stranki in koliko sporov se konča uspešno

Abstract:Alternative dispute resolution refers to all means of resolving disputes outside the courtroom. Alternative dispute resolution usually involves early neutral evaluation, negotiation, conciliation, mediation and arbitration. Due to rising court queues, rising costs of proceedings and time delays, this type of resolution is an increasingly common way of resolving commercial disputes. The key to resolving conflict situations in which companies find themselves is above all the speed of the procedure, confidentiality, greater flexibility, and an approach that will primarily enable the parties to continue cooperating. The most common methods to which we will pay the most attention through the final task are mediation and arbitration. Arbitration is a more formal form than mediation, and it largely reminds us of a simplified version of court proceedings. Compared to traditional trials, we find differences in the faster execution of the procedure itself and it is less formal. Mediation is so popular with individuals and legal entities because of its flexibility; control of the process held by the parties; confidentially; and above all because it maintains relationships. The mediator plays a key role during the procedure with his techniques and methods, due to which he can change the dynamics of the procedure. In order to substantiate all the above facts with evidence, the concluding part also presents statistics on how many commercial disputes have been referred to mediation, the number of consents given by both parties and how many disputes have been successfully concluded
