Title:Odločanje o varstvu in vzgoji otroka, preživljanju otroka in otrokovih stikih ob razvezi zakonske zveze : diplomsko delo

Abstract:Pomen zakonske zveze je v vzajemnem spoštovanju, razumevanju, zaupanju in medsebojni pomoči. Starši so dolžni skrbeti za pravice in koristi svojega otroka ter ga zaščititi pred bremenom osebnih partnerskih konfliktov. Slovenija je pravice otrok vključila v svoj pravni sistem na najvišji ravni, v 56. členu Ustave RS so te pravice posebej določene. Pravna podlaga je tudi v Družinskem zakoniku, ki zajema pravna načela in pravila, ki urejajo tudi varstvo otrokovih pravic kot tudi Konvencija o otrokovih pravicah. V zadnjem času je možno zaznati trend porasta števila razvez zakonskih zvez med zakonci, ki imajo velikokrat otroke, na katere ima ločitev staršev neposreden vpliv. Otroci so zelo redko vključeni v proces razveze zakonske zveze njihovih staršev, kar pa ne pomeni, da razveza na otroka ne vpliva, saj le ta pusti posledice bodisi kratkotrajne bodisi dolgotrajne, običajno pa vselej negativne. Pri razvezi zakonske zveze je ključnega pomena, da starša sporazumno rešita medsebojne spore ter se dogovorita o varstvu, vzgoji in preživljanja skupnih otrok. Ločitev staršev je za vsakega otroka posebej težka, zato je pomembno, da starši otroku pomagajo, da čim lažje preživi to stresno obdobje

Abstract:The importance of marriage is in mutual respect, understanding, trust and mutual help. Parents have a duty to care for the rights and benefits of their child and to protect them from the burden of personal partner conflicts. Slovenia has included the rights of children in its legal system at the highest level, and article 56 of the Constitution od the Republic of Slovenia specifically defines these rights. The legal basis is also in the Family Code, which includes legal principles and rules that also regulate the protection of children's rights as well as the Convention of the Rights of the Child. Recently, it is possible to detect an increasing trend in the number of divorces between spouses, who often have children who are directly affected by parental separation. Children are very rarely involved in the divorce process of their parents, which does not mean that divorce does not affect the child, as it leaves consequences that are either short-term or long-term, but usually always negative. In a divorce, it is crucial that the parents resolve their disputes amicably and agree on the care, upbringing and giving financial care to their joint children. Parental separation is difficult for each child, so it is important that parents help the child to live through this stressful period as easily as possible
