Title:Namestitev otroka v rejništvo : diplomsko delo

Abstract:Rejništvo spada na področje družinskega prava. Leta 2017 je bil sprejet novi Družinski zakonik, ki je zamenjal oziroma nadomestil Zakon o zakonski zvezi in družinskih razmerjih, uporabljati pa se je začel leta 2019. Rejništvo je posebna oblika vzgoje in varstva in je namenjeno otrokom, ki zaradi različnih razlogov ne morejo bivati pri svoji družini. Ključni namen rejništva je, da se otrokom pri osebah, ki niso njihovi starši, zagotovijo vzgoja, izobraževanje, zdrava rast, skladen osebnostni razvoj ter usposobitev za samostojno življenje in delo. Sodišče odloči o namestitvi otroka v rejništvo in o imenovanju rejnika, center za socialno delo pa potem sklene z rejnikom rejniško pogodbo, s katero je opredeljeno rejniško razmerje s pravicami in obveznostmi pogodbenih strank. Diplomska naloga obravnava predvsem področje odmerjanja in regulacije rejnine in rejništvo, ki se opravlja kot poklic, pri čemer sem se spraševala, ali so dopustne zlorabe. S pomočjo metode deskripcije sem prišla do zaključka, da je nov Družinski zakonik to področje drugače uredil, saj je po Zakonu o zakonski zvezi in družinskih razmerjih o namestitvi otroka odločal center za socialno delo, sedaj pa o tem odloča sodišče. Zaradi tega menim, da je namestitev v rejništvo bolj regulirana ter sistemsko urejena in je tako bistveno manj možnosti za morebitne zlorabe

Abstract:Foster care belongs to the field of family law. In 2017 a new Family Code was adopted, which replaced or substituted the Marriage and Family Relations Act, and came into force in 2019. Foster care is a special form of education and care for children who, for various reasons, are unable to stay with their family. The key purpose of foster care is to ensure that children, placed with persons other than their parents, take part of upbringing, education, healthy growth, harmonious personal development and training for independent living and work. The court decides on the placement of the child in foster care and on the appointment of a foster parent, and the social work centre concludes then a foster care contract with the foster parent, which defines the foster care relationship with the rights and obligations of the contracting parties. The thesis deals mainly with the field of assessment and regulation of foster care fees, and foster care, as a profession. I wondered whether abuses are permissible. Using the method of description, I came to the conclusion, that the new Family Code regulated this area differently, as according to the Marriage and Family Relations Act, the placement of a child was decided by the centre for social work, whereas now it is decided by the court. For this reason, I believe that foster care is more regulated and systemically regulated, and thus there is significantly less potential for possible abuse.
