Title:Starševski odtujitveni sindrom : diplomsko delo

Abstract:V diplomskem delu se ukvarjamo s tematiko odtujitvenega sindroma. Tema sodi na področje družinskega prava. Družina je skupnost enega ali obeh staršev z otrokom. Povezuje jih skrb za otroka, želja, da bi otroci zrasli v samostojne, zdrave odrasle osebe. Številne družine iz takšnih ali drugačnih razlogov tudi razpadejo. Otroci so v ločitvenih sporih največje žrtve. Diplomsko delo je sestavljeno iz treh glavnih delov. V prvem delu opisujemo teoretska izhodišča starševskega odtujevanja, tu predvsem poudarjamo Gardnerjevo teorijo PAS-sindroma. Gardner je starševski odtujitveni sindrom označil kot motnjo, do katere pride običajno ob razvezi, ko se starša bojujeta za varstvo in vzgojo otroka. Sindrom se kaže kot nepravično zavračanje enega od staršev. V tem poglavju omenjamo tudi nekatere kritike, ki so bile izrečene na Gardnerjevo teorijo in smeri razvoja. Drugi del govori o prepoznavanju starševskega odtujevanja, kjer povzemamo znake in dejanje starševskega odtujevanja. V tem poglavju tudi analiziramo nekatere primere slovenske sodne prakse. V zadnjem poglavju analiziramo mednarodno ureditev varovanja otrokovih pravic. Poudarjamo Konvencijo Združenih narodov o otrokovih pravicah in Evropsko konvencijo za uresničevanje otrokovih pravic kot temeljnih mednarodnih aktov na tem področju. Drugi del tega poglavja je namenjen normativnemu varovanju otrokovih pravic v Sloveniji, kjer se osredotočimo na ustavne določbe o varovanju otrokovih pravic. Sledi Družinski zakonik kot temeljni zakon, ki ureja področje otrokovih pravic v Sloveniji

Abstract:The diploma thesis deals with the topic of alienation syndrome. This topic falls under family law. A family is a community of one or both parents and a child. They are connected by their care for the child, and by the desire for the children to grow up into independent, healthy adults. Many families fall apart for one reason or another. Children are the biggest victims in divorce disputes. The diploma thesis consists of three main sections. The first section discusses the theoretical background of parental alienation, highlighting Gardner's PAS theory. Gardner defined the parental alienation syndrome as a disorder that usually occurs during divorce when parents are fighting for custody of the child. This syndrome manifests as an unjustified rejection of a parent. This chapter also mentions some of the criticism received by Gardner's theory and the development trends. The second section talks about identifying parental alienation, summing up the signs and actions of parental alienation. This chapter also analyses a few examples of Slovenian case law. The final chapter analyses the international regulation of the protection of children's rights. It highlights the United Nations Convention on the Rights of the Child and the European Convention on the Exercise of Children's Rights as the basic international acts in this field. The second part of this chapter is dedicated to the normative protection of children's rights in Slovenia, focusing on the constitutional provisions regarding the protection of children's rights. This is followed by a presentation of the Family Code as the basic act governing children's rights in Slovenia
