Abstract:O skrbništvu govorimo, kadar gre za varstvo oseb, ki še niso dopolnile 18 let starosti in za katere starši ne skrbijo ter odraslih oseb, torej oseb, ki so že dopolnile 18 let ter iz določenih razlogov ne morejo skrbeti same zase, prav tako pa ne morejo poskrbeti niti za svoje pravice in koristi. Skrbništvo deluje z namenom, da se poskrbi za te osebe in zavaruje njihove premoženjske in druge pravice in pa same koristi oseb. Ločimo tri oblike skrbništva: skrbništvo nad osebami, ki še niso dopolnile 18 let; nad osebami, ki so brez poslovne sposobnosti in skrbništvo za poseben primer. Torej skrbništvo nad osebami, ki so brez poslovne sposobnosti ali drugače imenovano skrbništvo za odrasle osebe, bo podrobneje opisano v tej diplomski nalogi. CSD dodeli skrbništvo osebi, ki ji je sodišče z odločbo odvzelo poslovno sposobnost. Zakon o nepravdnem postopku določa, da v postopku za odvzem poslovne sposobnosti sodišče odloča o delnem ali popolnem odvzemu poslovne sposobnosti osebam, ki so duševno bolne, duševno zaostale, odvisne od alkohola ali mamil, ali pa na njihovo psihofizično stanje vpliva kaj drugega in te osebe niso sposobne same skrbeti zase, za svoje pravice in koristi. Sodišče v nepravdnem postopku odloča na podlagi dokazov, ki jih ima, na podlagi zaslišanja prizadete osebe, izvidov in mnenj sodnih izvedencev. Skrbništvo nad posameznikom, ki so mu odvzeli poslovno sposobnost, preneha, če mu sodišče z odločbo le-to vrne. Lahko pa sodišče zaradi izboljšanja stanja osebe, ki ji je bila odvzeta poslovna sposobnost, izda odločbo, s katero popolni odvzem spremeni v delni odvzem poslovne sposobnosti. Skrbništvo preneha tudi s smrtjo osebe, ki je brez poslovne sposobnosti

Abstract:Guardianship is a special form of protect for young people who are not cared for by their parents. It’s also for adults who, for various reasons, cannot take care for themselves, for their rights and benefits. The purpose of guardianship is to take care of those people and protect their property and other rights and benefits. We distinguish three types of custody: custody of minors ,custody of persons deprived of legal capacity and custody for a special case. In my diploma I will describe custody of persons deprived of legal capacity or custody of adults. The Center for Social Work is placed under the custody of persons whose legal capacity has been revoked by a court decision. The Unjustified Procedure Act stipulates that in proceedings for individual legal capacity, the court decides on the partial or complete deprivation of legal capacity of persons who, due to mental illness, mental retardation, alcohol or drug addiction, or another cause affecting the psychophysical condition, they are not able to take care of themselves, their rights and benefits. In an improper procedure, the court decides based of the evidence they have on the basis of the hearing of the affected persons, the results and the opinions of forensic experts. With the complete deprivation of legal capacity, the affected person has the position of a minor who is not yet fifteen years old, and with partial deprivation he has the position of a minor who is already fifteen years old. Custody of a person deprived of legal capacity is transferred if the court by a decision returns his legal capacity. If the condition of the person who have been deprived of their legal capacity improves, the court may issue a decision that total deprivation of legal capacity, may be changed to a partial deprivation of legal capacity. Custody ends with a death of the person deprived of legal capacity
