Title:Pravica do svobode gibanja ter pravica do svobode in varnosti v času epidemije : magistrsko delo

Abstract:V magistrskem delu sta predstavljeni dve pravici – svoboda gibanja ter svoboda in varnost. Vsak človek se s tema pravicama že rodi. Obe sta bili v razvitih državah v zadnjem desetletju nedotakljivi in spoštovani. Seveda so obstajale določene kršitve, ki so se reševale na nacionalnih sodiščih držav ter sodiščih za človekove pravice, vendar nič takšnega, kar bi vplivalo na širšo javnost. Obe pravici imata pravno podlago v številnih mednarodnih dokumentih o človekovih pravicah in temeljnih svoboščinah, in v ustavah držav članic EU in izven nje. V zadnjem letu in pol se je to spremenilo. Nastopila je epidemija, ki se je razširila na pandemijo, in s tem ogrozila obe zgoraj omenjeni pravici. Ta epidemiološka kriza je imela za posledico tudi močna poseganja v pravice in svoboščine. Ljudje so se kmalu zavedali, da pravice niso absolutne in so jim lahko za določen čas močno omejene. V letu in pol je nastalo precej sodne prakse na različnih stopnjah sodišč v različnih državah. V magistrskem delu je predstavljenih nekaj primerov sodne prakse, ki se navezujejo na omenjeni pravici in kako so sodišča sprejemala odločitve. Izpostavljeno je predvsem Ustavno sodišče.

Abstract:The master's thesis presents two rights - freedom of movement and freedom and security. Every human being is already born with these rights. Both have been untouchable and respected in developed countries over the past decade. Of course, there were certain violations that were dealt with in the national courts of the states and the courts of human rights, but nothing that would affect the general public. Both rights have a legal basis in a number of international instruments on human rights and fundamental freedoms, and in the constitutions of EU Member States and beyond. This has changed in the last year and a half. An epidemic ensued that spread to the pandemic, threatening both of the above-mentioned rights. This epidemiological crisis has also resulted in strong encroachments on rights and freedoms. People soon realized that rights were not absolute and could be severely restricted for a period of time. In a year and a half, a considerable amount of case law has emerged at different levels of the courts in different countries. The master's thesis presents some examples of case law related to this right and how the courts made decisions. The Constitutional Court is particularly exposed.
