Title:Skupno premoženje zakoncev – problematika nevpisanih lastninskih položajev : magistrsko delo

Abstract:Skupno premoženje zakoncev predstavlja poseben način pridobitve lastninske pravice na podlagi posebnih pravil o skupnem premoženju zakoncev, ki jih ureja Družinski zakonik. Slednji v svojem 67. členu določa, da v skupno premoženje zakoncev spadajo vse premoženjske pravice, ki so bile pridobljene z delom ali odplačno med trajanjem zakonske zveze in življenjske skupnosti zakoncev. V skupno premoženje zakoncev je všteto tudi premoženje, ki je pridobljeno na podlagi in s pomočjo skupnega premoženja oziroma iz premoženja, ki iz njega izhaja. Družinski zakonik tudi določa, da imata zakonca na stvareh iz skupnega premoženja skupno lastnino. Gre za originarno in zunajknjižno pridobitev lastninske pravice, ki nastane na podlagi samega zakona, vpis v zemljiško knjigo pa je zgolj deklaratornega pomena. Posledično v praksi ostajajo pridobitve na podlagi zakona največkrat nevpisane in je zemljiškoknjižno stanje napačno, kar povzroča spore med imetniki nevpisanih pravic in tretjimi, ki za njimi pridobijo pravice na isti stvari. Pri presojanju v teh sporih odigra ključno vlogo načelo javnosti ali publicitetno načelo v povezavi z načelom zaupanja v zemljiško knjigo, saj se publiciteta stvarnih pravic na nepremičninah zagotavlja z ustreznim vpisom v zemljiško knjigo. V takih primerih je treba tehtati med interesi imetnika nevpisane pravice na eni strani in interesi tretjega, ki v dobri veri pridobi pravico na nepremičnini na drugi strani. Osrednji predmet proučevanja magistrskega dela je problematika skupnega premoženja zakoncev z vidika nevpisanih lastninskih položajev.

Abstract:The joint property of the spouses represents a special way of acquiring the right of ownership, on the basis of special rules on the joint property of the spouses, which are regulated by the Family Code. The latter stipulates in its Article 67 that the joint property of the spouses includes all property rights that were acquired through work or remuneration during the duration of the marriage and the life union of the spouses. The joint property of the spouses also includes property acquired on the basis of and with the help of the joint property or from the property deriving from it. The Family Code also stipulates that the spouses have joint ownership of things from the common property. It is an original and off-book acquisition of the right of ownership, which arises on the basis of the law itself, and the entry in the land register is of only declaratory significance. As a result, in practice, acquisitions under the law often remain unregistered and the land registry is incorrect, which causes disputes between holders of unregistered rights and third parties who acquire rights to the same thing. The principle of publicity or the principle of publicity in connection with the principle of trust in the land register plays a key role in adjudication in these disputes, as the publicity of real rights in real estate is ensured by appropriate entry in the land register. In such cases, it is necessary to weigh between the interests of the holder of the unregistered right on the one hand and the interests of a third party who in good faith acquires the right to immovable property on the other hand. The central subject of the study of the master's thesis is the issue of joint property of the spouses from the point of view of unregistered property positions
