Title:Varstvo človekove pravice do življenja v času pandemije COVID-19 : magistrsko delo

Abstract:Varstvo človekove pravice do življenja je v času pandemije covid-19 zahtevalo neobičajne in izredne ukrepe, ki so za namen varovanja zdravja in življenja ljudi posegli v druge človekove pravice. Magistrsko delo s pomočjo normativno-dogmatične, deskriptivne, analitične, vrednotenjske in primerjalne ter sintetične metode poskuša odgovoriti na vprašanja, ali pandemija covid-19 predstavlja izredne razmere, v katerih je za varstvo človekove pravice do življenja nujno potrebno sprejeti ukrepe, s katerimi se omejijo druge človekove pravice in temeljne svoboščine, ali so bili posegi v pravice in temeljne svoboščine v času pandemije covid-19 v naši državi pretežno pravno dopustni in sorazmerni ter ali so si države v času pandemije covid-19 medsebojno pomagale pri varstvu človekove pravice do življenja in pri odpravljanju posledic pandemije v duhu solidarnosti. Magistrsko delo se uvodoma osredotoča na pravno ureditev človekove pravice do življenja, nadaljuje pa s pravno ureditvijo izrednih razmer in pojmov epidemije ter pandemije. Nato obravnava ukrepe, ki so bili za varstvo zdravja in življenja ljudi sprejeti v naši državi, v dveh drugih državah, na ravni Evropske unije in na mednarodni ravni. Opravljena je presoja dopustnosti in sorazmernosti nekaterih ukrepov ter izpostavljena problematika sprejemanja nekaterih ukrepov. Na koncu magistrsko delo proučuje sodelovanje držav pri varstvu človekove pravice do življenja v času pandemije covid-19 in pri odpravljanju posledic pandemije covid-19. Na podlagi vseh ugotovitev je mogoče zaključiti, da je bilo treba za varstvo človekove pravice do življenja v času pandemije covid-19 sprejeti ukrepe, s katerimi so se omejile druge človekove pravice in temeljne svoboščine, da so bili le nekateri ukrepi v naši državi dopustni in sorazmerni ter da so si države medsebojno pomagale pri varstvu človekove pravice do življenja v času pandemije covid-19 in pri odpravljanju posledic pandemije covid-19. Magistrsko delo s svojimi ugotovitvami prispeva k boljšemu razumevanju, kako je bila pravica do življenja varovana v času pandemije covid-19 in kakšni ukrepi za varovanje pravice do življenja so dopustni in sorazmerni. Ugotovitve koristijo pri sprejemanju novih ukrepov za varovanje pravice do življenja v prihodnosti in prispevajo k boljšemu varstvu človekovih pravic in temeljih svoboščin.

Abstract:The protection of the human right to life during the covid-19 pandemic required unusual and extraordinary measures that interfered with other human rights for the purpose of protecting human health and life. The master's thesis uses normative-dogmatic, descriptive, analytical, evaluation and comparative and synthetic methods to answer the question of whether the covid-19 pandemic represents an emergency situation in which the protection of the human right to life requires urgent measures to limit other human rights and fundamental freedoms, whether interferences with rights and fundamental freedoms during the covid-19 pandemic in our country were largely legally permissible and proportionate, and whether countries helped each other during the covid-19 pandemic to protect human rights to life and in dealing with the consequences of a pandemic in a spirit of solidarity. The master's thesis initially focuses on the legal regulation of the human right to life, and continues with the legal regulation of emergencies and the concepts of epidemic and pandemic. It then discusses the measures taken to protect human health and life in our country, in two other countries, at European Union level and internationally. An assessment of the admissibility and proportionality of certain measures is made, as well as the issue of the adoption of certain measures. Finally, the master's thesis examines the participation of states in the protection of the human right to life during the covid-19 pandemic and in the elimination of the consequences of the covid-19 pandemic. Based on all the findings, it can be concluded that in order to protect the human right to life during the covid-19 pandemic, it was necessary to take measures to restrict other human rights and fundamental freedoms, that only some measures in our country were permissible and proportional and that countries have helped each other to protect the human right to life during the covid-19 pandemic and to address the consequences of the covid-19 pandemic. With its findings, the master's thesis contributes to a better understanding of how the right to life was protected during the covid-19 pandemic and what measures to protect the right to life are permissible and proportionate. The findings are useful in taking new measures to protect the right to life in the future and contribute to better protection of human rights and fundamental freedoms.
