Title:Pravice oseb s posebnimi potrebami v celo življenjskem obdobju : magistrsko delo

Abstract:Z magistrskim delom predstavljamo, kdo so osebe s posebnimi potrebami in njihove značilnosti. V nadaljevanju predstavimo pomembnejše stroke (pravno, zdravstveno in pedagoško), ki odigrajo poglavitno vlogo pri urejanju pravic oseb s posebnimi potrebami. Delo opisuje pravice, ki se dotikajo oseb s posebnimi potrebami v vsakem življenjskem obdobju, in predstavlja, kako so pravice urejene s predpisi in v sami praksi. Podrobneje se osredotočamo na kršitve, ki se dogajajo glede pravic in pomanjkljivosti v pravnih predpisih. Na področju določenih pravic primerjamo, kako so urejene pravice v Sloveniji in v tujih pravnih virih. Namen tega je, da bralec pridobi širšo sliko tega področja in primerjave Slovenije z drugimi državami. Prav tako opišemo pomembnejše Evropske institucije, ki vplivajo na sprejetje ali zaščito pravic in pomembnejše mednarodne ali evropske akte, ki vplivajo na to področje. V zaključnem delu jedra se osredotočimo na lastno raziskavo in predstavimo ugotovitve raziskave. Na podlagi ugotovitev in predstavitev podajamo možne rešitve, ki se dotikajo problematike pri uresničevanju pravic oseb s posebnimi potrebami. V zaključnem delu pridemo do lastnih ugotovitev in sklepanj, če Slovenija zagotavlja in izvršuje pravice.

Abstract:This thesis presents a definition of persons with special needs and their characteristics. Moreover, it also introduces key professions that play a crucial role in the management of their rights. This thesis also describes the lifelong rights that apply to persons with special needs and presents how these rights are dealt with in regulations and practice. Further emphasis is put on the violation of such rights and deficiencies in regulations. To give the reader a broader picture of the subject matter at hand and the differences between Slovenia and other countries, the thesis also compares the regulation of specific rights in Slovene and foreign legal sources. Moreover, it also introduces important European institutions that affect the adoption and protection of such rights and relevant international or European acts. The last part of the thesis focuses on personal research and presents its findings. Basing on the latter, potential solutions connected to the problematics of the exercise of rights that persons with special needs face are proposed. The conclusion brings forward personal findings and inferences about the enforcement and exercise of rights in Slovenia.
