Title:Postopek za ugotovitev in izpodbijanje očetovstva in materinstva : diplomsko delo

Abstract:S sprejetjem Družinskega zakonika in Zakona o nepravdnem postopku leta 2019 je prišlo do reforme družinskega prava. Diplomsko delo obravnava postopek za ugotavljanje in izpodbijanje starševstva po novi zakonodaji ter ga primerja s prejšnjo zakonodajo. Z ugotavljanjem in izpodbijanjem starševstva je neločljivo povezana otrokova pravica do poznavanja svojega izvora, ki je v zadnjih letih popolnoma stopila v ospredje. V Sloveniji je razmišljanje o tem, kako daleč naj gre pravo pri prizadevanju za biološko genetično resnico, spodbudilo Ustavno sodišče z odločbo, s katero je razveljavilo objektivni rok, v katerem je lahko otrok vložil tožbo za ugotavljanje očetovstva oziroma materinstva. Država je namreč dolžna zagotoviti ustrezne mehanizme, s katerimi lahko posameznik spozna resnico o svojem izvoru, seveda na način, ki zasleduje sorazmernost in legitimnost. Tako je nova zakonodaja ustrezneje določila roke, v katerih se lahko vlaga predlog, in posodobila seznam aktivno legitimiranih oseb. Postopek je po novem nepravden in se začne na predlog strank. V postopku dokazovanja je najpomembnejša DNK-analiza, ki je najzanesljivejša metoda, s katero lahko ugotovimo biološke starše. Pomembna novost je tudi dolžnost sodelovanja udeleženca z izvedencem v postopku dokazovanja starševstva

Abstract:Adoption of the Family Code and of the Non-Contentious Civil Procedure Act in 2019 reformed family law. The diploma thesis examines the procedure of establishing and contesting parenthood under the new legislation, and compares it with the old one. The act of establishing and contesting parenthood is inextricably linked to the child's right to know his/her parentage, which has come to the fore in recent years. In Slovenia, reflection on how far law should go in striving for biological genetic truth has been triggered by the Constitutional Court's ruling repealing the objective time limit in which a child may bring an action to determine paternity or maternity. The state is obligated to provide suitable mechanisms with which a person can find the truth of his/her parentage, of course, in a proportional and legitimate way. Thus, the new legislation has more appropriately defined the time limits in which a motion can be filed, and has updated the list of persons actively legitimized. The procedure is now a non-contentious one and is initiated at the request of the parties. The most important element in the procedure of proving parenthood is the DNA analysis, which is the most reliable method of finding the truth about one's biological parents. Another important novelty is the participant's duty to cooperate with the expert in establishing proof.
