Title:Ugotavljanje skupnega in posebnega premoženja zakoncev ob razvezi : diplomsko delo

Abstract:V diplomskem delu je predstavljena slovenska ureditev premoženjskih razmerij, ki ponuja dva sistema premoženjskih režimov. Prvi je pogodbeni sistem, ki ga je DZ vzpostavil v svojem 85. členu - pogodba o ureditvi premoženjskopravnih razmerij. Slednji predstavlja novost in omogoča avtonomijo zakoncev. Drugi sistem pa predstavlja obligatorni način in ima svojo obvezo le takrat, kadar zakonca tega ne uredita drugače. Obligatorni režim predpostavlja tri ločene premoženjske mase. Z vidika ugotavljanja skupnega in posebnega premoženja zakoncev ob razvezi so relevantni vsi našteti. Najpomembnejše premoženje, ki ga tvorita zakonca, je skupno premoženje. Zakonca s tem pridobita poseben status napram okolici. Takšna ureditev je nastala zaradi posebne narave sklenitve zakonske zveze. Zakonca pravno gledano s sklenitvijo zakonske zveze skleneta pravni posel, ki ni ekonomske narave temveč združevanje dveh posameznikov zaradi osebne čustvene povezanosti med njima v skupno življenje. Ravno zaradi narave zakonske zveze, ki ni enoznačna, vsebino dopolnjuje sodna praksa. Težave se pokažejo v sami delitvi skupnega premoženja, kadar zakonca ne soglašata z domnevo enakosti deležev, saj je dokazovanje višine lastnega deleža na strani zakoncev. Pogosto je rezultat odvisen od lastnosti in sposobnosti ter finančnega statusa posameznika. Ker pa skupno premoženje ni edina premoženjska masa, se opredelimo še do premoženjske mase moža in žene, ki predstavlja njuno posebno premoženje. S premoženjem je potrebno delati z vso skrbnostjo, tudi v primeru vlaganja lastnega premoženja v drugo premoženje zakonca. Sporazumi in dogovori so v primeru spora najboljša rešitev za reševanje premoženjskih razmerij med zakoncema.

Abstract:The diploma thesis presents the Slovenian regulation of property relations, which offers two systems of property regimes. The first is the contractual system established by Article 85 of the Family Code - the marital property agreement. This system represents a novelty and allows autonomy of spouses. The other system, however, is an obligatory system and is required only when spouses do not come to a different arrangement. The obligatory regime includes three separate sets of property. From the perspective of determining the co-owned and personal property of spouses at the time of divorce, all are relevant. The most important spouses' property is co-owned property. With this property, spouses acquire a special status in relation to their surroundings. This arrangement arose because of the special nature of marriage. From a legal point of view, by entering into marriage, the spouses conclude a legal transaction that is not of an economic nature but the union of two individuals, due to a personal emotional connection, to form a common life. Because of the nature of marriage, which is not unambiguous, the subject matter is supplemented by case law. Problems arise in the division of co-owned property when spouses do not agree with the presumption of equality of their shares, as establishing the value of their shares is up to the spouses. Often the results depend on the characteristics, abilities and financial status of the individual. However, as co-owned property is not the only property, we also define the properties of the husband and the wife, which represent their personal properties. Property must be handled with due diligence, even in the case of investing one's own property in other property of the spouse. Agreements and arrangements are the best solution to resolve property relations between the spouses in the event of disputes.
