Title:Pravice starih staršev in vnukov do družinskega življenja na primeru koroških dečkov : diplomsko delo

Abstract:Diplomsko delo povzema institute, ki opisujejo, pod katerimi pogoji lahko stari starši prevzamejo skrb in vzgojo za svoje vnuke. V zvezi z vsebino so postavljene hipoteze, ki so obravnavane v zaključku. Glavni vir informaciji je sestavljen iz analize strokovne literature, praktičnih primerov in zakonodajnih aktov. Tako je bila kot glavna raziskovalna metoda uporabljena deskriptivna metoda. Glavni namen naloge je predstaviti starim staršem, staršem ter vsem preostalim, kakšne pravice imajo stari starši in vnuki do družinskega življenja, če starši trajno ne morejo več izvajati starševske skrbi. Tako so v diplomski nalogi opisane značilnosti in pogoji družinskopravnih institutov, kjer so nosilci starševske skrbi stari starši: stari starši kot rejniki, stari starši kot skrbniki ter nov institut podelitev starševske skrbi sorodniku, kjer to vlogo lahko prevzamejo stari starši. V diplomski nalogi je tudi predstavljen primer koroških dečkov, ki je potekal in še vedno poteka pred slovenskimi sodišči, ter še nekateri primeri družinskega življenja vnukov in starih staršev, o katerih je odločalo Evropsko sodišče za človekove pravice. Prav tako tudi primer koroških dečkov še vedno ni zaključen na Evropskem sodišču za človekove pravice. Cilj diplomskega dela je tudi bralcu predstaviti nova instituta, ki ju je uvedel Družinski zakonik – podelitev starševske skrbi sorodniku ter vnaprej izražena volja staršev.

Abstract:The thesis summarizes the institutes that describe the conditions under which grandparents can take care of and upbringing their grandchildren. Regarding the content, hypotheses are set out, which are discussed in the conclusion. The main source of information consists of an analysis of the professional literature, practical examples and legislative acts. Thus, a descriptive one was used as the main research method. The main purpose of the task is to present to grandparents, parents and everyone else what rights grandparents and grandchildren have to family life if parents are no longer able to perform parental care permanently. Thus, the diploma thesis describes the characteristics and conditions of family law institutes where the guardians of parental care are grandparents: grandparents as foster parents, grandparents as guardians and grandparents as adoptive parents. The diploma thesis also presents the case of »koroška dečka«, which took place and is still taking place before our Slovenian courts, as well as some other cases of family life of grandchildren and grandparents, which were decided by the European Court of Human Rights. Likewise, the case of the »koroška dečka« is still pending at the European Court of Human Rights. The aim of the diploma work is also to present to the reader the new institutes introduced by the Family Code – the granting of parental care to a relative and the will of parents expressed in advance.
