Title:Vpliv mednarodnega prava na preprečevanje uporabe otrok v oboroženih spopadih : magistrsko delo

Abstract:V magistrskem delu obravnavamo in proučujemo vpliv mednarodnega prava na preprečevanje uporabe otrok v oboroženih spopadih. Pojav otrok vojakov, ki ga srečujemo v celotni zgodovini vojskovanja, je kljub nenehnim prizadevanjem mednarodne skupnosti in instrumentov mednarodnega prava, ki obravnavajo to problematiko, še vedno velik družbeni problem. Kot temeljno raziskovalno metodo v magistrskem delu uporabimo metodo analize ter interpretacije primarnih in sekundarnih virov, s katerimi se osredotočamo predvsem na analizo verodostojne strokovne literature, normativnih aktov in drugih strokovnih člankov. Poudariti želimo zavezujoče mednarodnopravne standarde s področja mednarodnega humanitarnega prava in prava človekovih pravic, ki obravnavajo vprašanje zaščite otrok pred njihovim nezakonitim novačenjem za sovražnosti. Za proučevanje uresničevanja preprečevanja uporabe otrok v oboroženih spopadih uporabljamo primerjalno metodo, s katero določamo glavne notranje in zunanje akterje oboroženega konflikta v Siriji in nadalje proučujemo njihovo vlogo pri novačenju otrok za sovražnosti, ne samo na ozemlju Sirije, temveč tudi zunaj nje. V raziskavi ugotovimo, da sirska vlada kot nosilka oblasti v Siriji od začetka oboroženih spopadov leta 2011 ni sprejela ustreznih ukrepov, s katerimi bi učinkovito zaščitila otroke pred novačenjem za sovražnosti na svojem ozemlju. V magistrskem delu sklenemo, da prizadevanja mednarodne skupnosti za vzpostavitev učinkovite mednarodnopravne zaščite otrok spodkopavajo številna protislovja v mednarodnem pravu, ki odpirajo prostor vprašanju, ali je sploh mogoča učinkovita mednarodna zaščita otrok v oboroženih spopadih

Abstract:The Master's thesis deals with and explores the implications of international law on preventing the use of children in armed conflicts. The phenomenon of child soldiers, which has been re-occurring throughout the entire history of warfighting, still remains a major social problem despite the continuous efforts of the international community and international law instruments addressing these issues. The basic research method applied in the thesis is analysis and interpretation of primary and secondary sources, with particular focus on analysing credible professional resources, normative documents and other professional articles. The author specifically concentrates on binding international legal standards and human rights law which address the issue of children's protection against illegal recruitment for hostilities. The analysed implementation of preventing the use of children in armed conflicts is based on comparative method, which is used for identifying major internal and external actors of the armed conflict in Syria and for the further analysis of their role in recruiting children for hostilities not only in the territory of Syria, but also beyond its borders. The research findings reveal that ever since the outbreak of armed conflicts in 2011 the Syrian government as the holder of power has not taken any measures to efficiently protect children against recruitment for hostilities in the territory of Syria. The conclusion of the Master's thesis indicates that the efforts of the international community to establish efficient international legal protection of children are undermined by numerous contradictions in international law, thus raising the question whether efficient international protection of children during armed conflicts is at all possible
