Title:Prihodnost razvoja EU kot sui generis federacije : magistrsko delo

Abstract:Magistrsko delo skuša poiskati ustrezno definicijo EU; označi jo kot umetno, politično tvorbo, kot sui generis entiteto, ki kaže svojo edinstvenost v mednarodni skupnosti, saj že vsebuje nekatere nadnacionalne elemente, ki so sicer značilni za federacije, pri čemer vsebuje tudi konfederalne, medvladne elemente. Naloga se dotakne tudi ostalih teoretičnih izhodišč, ki v sami naravi poskušajo definirati EU že več desetletij, in pojasnjuje zgodovinske okoliščine nastanka EU ter izmenjavo teoretičnih pristopov skozi razvoj Unije. Magistrsko delo sledi svoji rdeči niti, saj se skozi poglavja osredotoča na razvoj EU kot sui generis federacije; definira elemente, ki bi jih EU morala po kvalifikaciji federacije imeti, pri čemer omenja tudi odsotnost glavnih elementov, značilnih za federacijo. V jedru se delo osredotoča na notranje in zunanje delovanje EU, pri čemer se dotakne tako slabosti kakor tudi prednosti tovrstnega delovanja. V osrednjem delu tako skuša pojasniti ustrezno ravnovesje znotraj Unije, in sicer med delovanjem nacionalne in nadnacionalne ravni, zato se dotakne vprašanj o razdelitvi moči, hierarhičnosti in heterarhičnosti, suverenosti, primarnosti in subsidiarnosti, omenja pa tudi ostala načela, ki so bistvena pri pojasnjevanju strukturnega ravnovesja. Naloga se zaključuje z možnostmi razvoja EU v prihodnosti, predvsem z vidika razvoja federacije sui generis, upoštevajoč mednarodne tendence in obstoječe razmere na evropskem kontinentu, kot so rast evroskepticizma, pojavnost političnih skrajnosti, novih kriz in druge

Abstract:The master's thesis seeks to find the most accurate definition of the EU; whereas the EU is explained as an artificial, political entity, as a sui generis formation with its uniqueness, as it contains some supranational characteristics being typical for federations on one hand, and confederal, intergovernmental elements on the other hand. Thesis also touches upon other theoretical approaches, which have been trying to define the EU, historical circumstances that led to the creation of the Union and the exchange of theoretical approaches through its development. Thesis tries to explain the development of the EU from a perspective of already being sui generis federation; therefore, it defines the elements that the EU as a kvazi feneration should have, while noting the absence of the main elements specific for federations. In its core, the work focuses on internal and external functioning of the Union, highlighting both the disadvantages and advantages of such. The central part of the work seeks to clarify the balance between national and supranational levels, addressing issues such as power distribution, hierarchy and heterarchy, sovereignty, primacy and subsidiarity, and other principles that are essential in clarifying structural balance within the Union. In conclusion the work focuses on possibilities of the Union's future development, from a perspective of defining the EU as already being sui generis federation, taking into account international tendencies and the current situation in the European continent; euroscepticism, extreme political parties, new challenges and others
