Title:Vloga javne radiotelevizije v sodobni demokratični družbi : magistrsko delo

Abstract:Javna radiotelevizija je množični medij v službi celotne javnosti, njeno delovanje pa je tesno povezano z ustavno demokracijo in uresničevanjem človekovih pravic, v ospredju katerih je pravica do svobode izražanja. Vloga sodobne javne radiotelevizije ni zgolj v tem, da informira, izobražuje, skrbi za jezik in kulturo ter zabava, temveč ima še posebno poslanstvo, ki je v tem, da spodbuja demokratične vrednote, vladavino prava in socialno kohezijo. Takšno vlogo ji pripisuje Svet Evrope, povezava med javno radiotelevizijo in demokratičnimi, socialnimi in kulturnimi potrebami družbe ter zahtevami medijskega pluralizma pa izhaja tudi iz pravnega reda Evropske unije. Javni mediji so značilnost evropskega dualnega medijskega sistema, v katerem poleg komercialnih medijev delujejo še javni, ki so večinoma financirani iz javnih sredstev. Stabilno in zadostno financiranje za javno radiotelevizijo pomeni, da lahko deluje neodvisno od političnih in gospodarskih vplivov, pri čemer večina vsebin, ki jih ponuja, ni komercialno naravnana. Zaradi kulturnih in političnih razlik med državami EU je na tem področju težko vzpostaviti enotno politiko, zavezujoče določbe prava EU se nanašajo le na področje financiranja. Obstajajo pa določene skupne vrednote, ki jih je v obliki načel v svojih dokumentih sprejel Svet Evrope. Te služijo kot pomoč sooblikovalcem medijske politike in kot argumenti v odločitvah najvišjih sodišč, kadar odločajo o kršitvah svobode izražanja zaradi posegov v novinarsko in uredniško svobodo, in v primerih, ko je ogrožena finančna ali institucionalna neodvisnost javnega medija. Programi javne radiotelevizije morajo zagotavljati različne in kvalitetne vsebine, ki morajo odražati družbeno raznolikost, tako kulturno kot politično, javnost pa ima pravico, da takšne vsebine zahteva. Varuh pravic gledalcev in poslušalcev je institut, ki bi lahko prispeval k učinkovitejšemu sodelovanju z javnostjo

Abstract:Public service broadcasting is a mass medium in the service of the entire public. Its activities are closely linked to constitutional democracy and the exercise of human rights, at the forefront of which is the right to freedom of expression. The role of modern public service broadcasting is not only to inform, educate, care for language, culture and entertainment, but also to promote democratic values, the rule of law and social cohesion. Such a role is attributed to it by the Council of Europe, and the link between public service broadcasting and the democratic, social and cultural needs of society and the requirements of media pluralism also derives from EU law. Public media are a feature of the European dual media system in which, in addition to commercial media, there are also public ones, which are mostly financed from public funds. Stable and sufficient funding for public service broadcasting means that it can operate independently of political and economic influences, with most of the content it offers not being commercially oriented. Due to cultural and political differences between EU countries it is difficult to establish a unified policy in this area and the binding provisions of EU law apply only to the field of funding. However, there are certain common values adopted by the Council of Europe in the form of principles in its documents. These serve as an aid to co-creators of media policy and as arguments in the decisions of the highest courts when deciding on violations of freedom of expression due to interference with journalistic and editorial freedom and in cases where the financial or institutional independence of the public media is threatened. Public service broadcasting must provide diverse and high-quality content that must reflect social diversity, both culturally and politically and the public has the right to request such content. The Ombudsman for Viewers and Listeners is an institute that could contribute to more effective cooperation with the public
