Abstract:V diplomski nalogi je predstavljen razvoj koncepta »zločini zoper človečnost« v zadnjih petinsedemdesetih letih. V prvem delu diplomske naloge je kronološko predstavljeno dogajanje prve in druge svetovne vojne, ki je neločljivo povezano s samim potekom sojenj v Nürnbergu in sojenj v Tokiu. Predstavljeni so zločini, ki so zaznamovali nekdanjo Jugoslavijo in ob približno istem času tudi Ruando. Sledi obravnavanje odgovora mednarodne skupnosti na dejanja iz devetdesetih let s pomočjo Rimskega statuta in ustanovitvijo Mednarodnega kazenskega sodišča ter predstavitev vloge ILC v najnovejšem poskusu dokončnega definiranja koncepta ter pravnoformalnega pogleda na samo preganjanje in kaznovanje storilcev za kazniva dejanja zločinov zoper človečnost. V diplomski nalogi sta v večjem delu uporabljeni deskriptivna in zgodovinska metoda, v manjšem obsegu tudi analitična metoda, predvsem v začetnem delu za opis ključnih pojmov, v končnem delu pa sintetična metoda za povzetek diplomskega dela. Namen diplomskega dela je preučiti, kako je v mednarodnem pravu urejen koncept »zločini zoper človečnost«, cilj pa je ugotoviti, kako se je razvijalo mednarodno pravo na tem področju in kako mednarodno pravo dandanes pripomore k preprečevanju tovrstnih zločinov. Diplomska naloga bralcu na pregleden način omogoča vpogled v razvoj samega koncepta.

Abstract:The diploma thesis presents the development of the concept of »crimes against humanity« in the last seventy-five years. The first part of the diploma thesis chronologically presents the events of the First and Second World War, which are inextricably linked to the trials in Nuremberg and Tokyo, as well as the crimes, that marked the former Yugoslavia and Rwanda at about the same time. This is followed by a discussion of the international community's response to the nineties with the help of the Rome Statute and the establishment of the International Criminal Court, and finally a presentation of the ILC's role in the latest attempt to finalize the concept and legally formalize it. In the diploma thesis, the descriptive and historical methods are mostly used, to a lesser extent, also an analytical method - especially in the initial part to describe key concepts, and in the final part a synthetic method for the entire summary of the thesis. The purpose of this diploma thesis is to examine how the concept of "crimes against humanity" is regulated in international law. The aim is to determine how international law has developed in this area and how international law nowadays contributes to the prevention of such crimes. The diploma thesis itself provides the reader with an insight into the development of the concept in a transparent way.
