Title:Postopki in pooblastila policistov v cestnem prometu – poseg v pravice in temeljne svoboščine državljanov : diplomsko delo

Abstract:V okviru nalog policije se policisti vsakodnevno dejavno ukvarjajo z nadzorom in urejanjem cestnega prometa bodisi z vidika represije bodisi preventivne dejavnosti. Voznika v cestnem prometu policija načeloma ustavi le takrat, ko obstaja konkreten razlog. Izjema so poostreni nadzori in preventivne akcije Policije. Storilci prekrškov in morebitni storilci kaznivih dejanj načeloma ne poznajo policijskih postopkov, hkrati pa ne vedo točno, zakaj jih policija ustavlja in preverja, najsi bo to poostren nadzor cestnega prometa, ugotavljanje psihofizičnega stanja voznikov ali zgolj zaradi raznih preventivnih akcij. Ker pogosto mislijo, da je razlog zaustavitve prav njihovo odklonsko ravnanje, nemalokrat v postopku ne želijo sodelovati, se pasivno ali aktivno upirajo ali policiste celo napadejo, saj po večini ne vedo, kakšne pravice imajo v postopku s policistom. Glavna tema, ki je tudi vsebina našega dela in na katero bomo najbolj pozorni, je uporaba policijski pooblastil v postopkih, ki jih policisti vodijo v cestnem prometu, ki morajo seveda biti v skladu z Zakonom o nalogah in pooblastilih policije, na podlagi Zakona o organiziranosti in delovanju policije. Uporaba mora torej temeljiti na spoštovanju zakona ali drugega predpisa, kakor tudi na tem, da so podani vsi pogoji, ki dopuščajo uporabo takega pooblastila. V diplomskem delu smo predstavili omejitve človekovih pravic in spoštovanje slednjih v policijskih postopkih. Predstavili smo etiko v policiji, Kodeks slovenske policije in Evropski kodeks policije ter varstvo človekovih pravic v policijskih postopkih.

Abstract:As part of their tasks police officers are actively involved in the supervision and regulation of road traffic. Either in terms of repression as well as preventive activities. A driver is in principle, stopped by the police only when there is a concrete reason for it. The exceptions are stricter controls and preventive actions. Perpetrators of misdemeanors and potential perpetrators of criminal offenses in general do not know procedures and do not know exactly why the Police stops and controls them, whether it is strict road traffic control, determining the psychophysical condition of drivers or simply for various preventive actions. Because they often think that the reason for being stopped is their deviant behavior, they often do not want to participate in the proceedings, passively or actively resist or even attack police officers. Most of them do not know what rights they have in proceedings. The main topic is the use of police powers in procedures conducted by police officers on the road traffic, which must of course be in accordance with the Police Duties and Powers Act. The application must therefore be based on compliance with a law or other regulation. The use of an individual authorization must also be based on the fact that all conditions are allowed that allow the use of such an authorization. In my dissertation, I presented the restrictions on human rights and respect for them in police proceedings. Here I presented the ethics in the police, the Slovenian Police Code and the European Police Code, as well as the protection of human rights in police proceedings.
