Title:Mednarodno pravni položaj države, nečlanice OZN : diplomsko delo

Abstract:Problematika temelji na mednarodnem pravnem delovanju držav članic v primeru reševanja sporov, ki včasih tudi zatakne, sploh ko je govora o vstopu nove članice kot je na primer Kosovo, ki seveda izpolnjuje vse pridružitvene pogoje iz 4. člena Ustanovne listine OZN o sprejemu in prav tako ni v neskladju mednarodnega prava. Problem nastane ko se redna članica Rusija poslužuje pravice do Veta in Kosovu preprečuje (blokira) vstop v članstvo OZN. Sprejetje take odločitve namreč nasprotuje ključnim interesom zagotavljanja miru in varnosti, ki je temelj stalnih članic OZN ter postavlja številna mednarodno-pravna vprašanja tudi danes o enakopravnosti, tako držav članic in nečlanic pri uživanju enakovrednih vprašanj in norm ter pogojev za včlanitev v OZN; kje so ločnice med uživanjem le-tega in pod kakšnimi pogoji. Iz ugotovitev lahko izluščimo samo, da tako države članice, kakor nečlanice OZN dejansko ne uživajo suverenosti enakosti vseh držav, saj so jim pogosto kršene temeljne norme mednarodnega prava in se pogosto ravnajo v nasprotju z načelom univerzalnosti organizacije, ki pa ima svoje korenine v sami Ustanovni listini in so kljub vsem poprej naštetim normam, še vedno pod določenim vprašanjem, kaj je torej mednarodno-pravno podprto in ob kakšnem pogoju.

Abstract:The issue is based on the international legal action of member states in the case of dispute resolution, which sometimes gets stuck, especially when it comes to the entry of a new member such as Kosovo, which of course meets all the conditions of association from Article 4 of the UN Charter. is not inconsistent with international law. The problem arises when a regular member of Russia exercises the right to the Veto and prevents (blocks) Kosovo from joining the UN. The adoption of such a decision runs counter to the key interests of peace and security, which is the cornerstone of the UN's permanent members and raises a number of international legal issues today on equality, both between Member States and non-member states in enjoying equal issues and norms and UN membership conditions; where are the dividing lines between consuming it and under what conditions. We can only deduce from the findings that both Member States and non-UN member states do not in fact enjoy the sovereignty of equality of all states, as they often violate fundamental norms of international law and often act contrary to the principle of universality of the organization. charter and, despite all the norms listed above, are still under a certain question, what is therefore internationally supported by law and under what conditions.
