Title:Pacientova pravica do zavrnitve zdravljenja

Abstract:V diplomskem delu z naslovom Pacientova pravica do zavrnitve zdravljenja smo predstavili in analizirali različne pravne akte, ki so odločilni za ureditev pacientove pravice do zavrnitve zdravljenja. Med mednarodnopravnimi dokumenti izpostavljamo Oviedsko konvencijo, Lizbonsko deklaracijo o bolnikovih pravicah ter ELPP. Temeljni nacionalni pravni vir je ZPacP. V diplomskem delu so predstavljeni pojmi pravice do samoodločanja, pojasnilna dolžnost zdravnika in pravne posledice, do katerih pride, če slednja ni ustrezno opravljena. Temeljni poudarek pa je na predstavitvi vsebine pravice do zavrnitve zdravstvene oskrbe ter pravice do odločanja o bodoči zdravstveni oskrbi. Ugotovili smo, da sta omenjeni pravici v Sloveniji urejeni v zadostni meri in na primeren način. Posamične pomanjkljivosti, na katere v nalogi opozorimo, so bolj kot ne posledica neustrezne uporabe zakonodaje v praksi, kot pa njenih resnih pomanjkljivosti. Menimo, da je prav, da se zakonska ureditev pojasnilne dolžnosti opira predvsem na strokovno usposobljenost zdravnika, pacient pa lahko, na podlagi pravilno izpolnjene pojasnilne dolžnosti, sprejme zanj najbolj ustrezno odločitev o zdravljenju. To je lahko tudi odločitev o zavrnitvi zanj, po mnenju zdravnika, potrebnega in primernega zdravljenja.

Title:Patient's right to refuse treatment
Abstract:In the graduation thesis with the title Patients' right to refuse treatment we introduced and analyzed various legislative acts that are significant for regulating the right to refuse treatment. Among international legislative acts we pointed out the Oviedo Convention, the Declaration of Lisbon on the Rights of the Patient and the European Charter of Patients’ Rights. Fundamental national legal reference is the ZPacP. In the graduation thesis we introduced patients’ right to self-determination, doctor’s duty to disclose all relevant information and legal consequences in failing to do so. The fundamental emphasis is on introducing the content of the right to refuse treatment and the right to an advance decision. We came to conclusion that the aforementioned rights are sufficient and appropriately regulated in Slovenia. Reasons for certain individual shortcomings that we point out in the thesis lie in the inappropriate application of the legislation in practice, rather than in its serious shortcomings. We believe it is right that the legal regulation of the doctor’s duty to disclose is based primarily on the professional qualifications of the doctor. The patient on the other hand can, based on the correctly fulfilled duty to disclose, make the most appropriate decision about his treatment. Latter may also be his refusal of treatment, which is, at least in doctor’s opinion, necessary and appropriate.
