Abstract:Diplomsko delo obravnava področje kibernetskega kriminala v elektronskem poslovanju ali e-trgovini. Z razvojem informacijsko-komunikacijskih tehnologij in posledično kibernetskega prostora se je razvil tudi kriminal znotraj kibernetskega prostora, tj. kibernerski kriminal. Diplomsko delo obravnava vprašanja, kaj je kibernetski kriminal in katere vrste poznamo ter kaj je elektronsko poslovanje in katere vrste kibernetskega kriminala se pojavljajo pri njem. Elektronska trgovina je v velikem razmahu že vrsto let, s trenutno situacijo, v kateri smo (mislim seveda na pandemijo in posledično karanteno zaradi covida-19), pa se je količina elektronskega poslovanja še povečala, saj so fizične trgovine začasno nehale poslovati. Z udeležbo v elektronskem poslovanju je vsak uporabnik v nevarnosti, da postane žrtev kibernetskega kriminiala, saj so tehnike, ki jih uporabljajo storilci, pogosto napredne in težko prepoznavne. Poznavanje in razumevanje vrst kibernetskega kriminala v e-trgovini sta ključnega pomena, da se lahko pred njim zaščitimo. Obravnavana je tudi pravna ureditev kibernetskega kriminala v mednarodnem okolju in v Sloveniji. Glavno vodilo diplomske naloge je spoznati, kako se kibernetski kriminal v e-trgovini pojavlja in kakšna je pravna ureditev le-tega.

Abstract:With the development of information and communication technologies and consequently cyberspace, crime committed within cyberspace has also developed, i.e. cybercrime. The thesis deals with the question of what is cybercrime and what types we know and what is e-commerce and what types of cybercrime occur there. E-commerce has been in full swing for many years, and with the current situation we live in (I'm talking about a pandemic and consequently quarantine due to the COVID-19 virus), the amount of e-commerce has increased even more, as physical stores have temporarily ceased operations. By participating in e-commerce, however, any user is at risk of becoming a victim of cybercrime, as the techniques used by the perpetrator are very advanced and difficult to identify. Knowing and understanding the types of cybercrime in e-commerce is crucial so that we can protect ourselves from it. By analyzing secondary sources and studying professional literature, scientific articles and Internet sources, I will use the method of description or and the method of summarizing to describe and define which forms of cybercrime are known in e-commerce. I will also use the method of statistical data analysis and, with the help of the method of comparison, compare the Slovenian legal regulation of cybercrime with EU legislation and international acts. The main guideline of the diploma thesis is to get to know how cybercrime occurs in e-commerce and what is its legal regulation in Slovenia and in other countries of the world.
